COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is entered into this 22nd day of September 2020, in __________,
Philippines, by and between:

ANNALIZA LUIS [“Annaliza”], Filipino, of legal age,

with residence address at 2515 Radium St., Brgy. 775, San
Andres Bukid, Manila, mother of minor children
EZEKIEL L. FAMATIGA [“Ezekiel”] and MATTHEW
EARL LUIS [“Matthew”]; and

-and-

JOMAR BANTANG LUIS [“Jomar”], Filipino, of legal

age, with residence address at San Jose, Dalahican Roxas,
Oriental Mindoro.

RECITALS

Annaliza and Ezekiel are the private complainants, while Matthew is the offended
party in Criminal Case. No. R-2033, entitled “People of the Philippines vs. Jomar
Bantang Luis” for Frustrated Murder, and Criminal Case No. R-2032 also entitled
“People of the Philippines vs. Jomar Bantang Luis” for violation of Republic Act 7610,
which are both pending before the Regional Trial Court Roxas, Oriental Mindoro, Branch
43.

After negotiations and discussions, the parties mutually realized and deemed it
best and convenient to resolve the civil aspect of the case in an amicable manner.

Both parties have come to a mutually beneficial arrangement as to the method of

payment and mode of settlement of the civil aspect by Jomar for the convenient and
immediate disposition of the case.

NOW THEREFORE, for and in consideration of the mutual covenants and

agreements herein established, the parties hereto agree to the terms of settlement:

1. The total amount of Five Hundred Thousand Pesos (Php 500,000.00)

shall be paid by Jomar to Annaliza in One Hundred (100) equal monthly installments, or
Five Thousand Pesos (Php 5,000.00) per month, starting 15 October 2020 until 3 March
2029, for the medical and psychological treatment of Matthew.

2. The parties shall jointly move for the provisional dismissal of the above
cases while the total amount of Five Hundred Thousand Pesos (Php 500,000.00) remain
unpaid. Whatever cash bond posted by Jomar for his provisional liberty shall be forfeited
in favor of Annaliza.

3. In the event, however, of a breach of any of the foregoing terms and

conditions stipulated herein, including the failure to make deposits despite demand,
Jomar obligates himself to pay the remaining balance of the principal amount, interest,
and attorney’s fees of ten percent (10%) of the outstanding balance and liquidated
damages of ten percent (10%) of the remaining balance in case there is a need to further
litigate, or the immediate execution of the Decision rendered by virtue of this
Compromise Agreement. Further this Agreement shall be used as evidence in any
proceedings, and shall be treated as an offer of compromise by Jomar.
 4. The parties agree to submit this Agreement for approval of the Regional
Trial Court Roxas, Oriental Mindoro, Branch 43, which Agreement will form the basis of
a Decision in the case abovementioned.

IN WITNESS WHEREOF, the parties hereto mutually and voluntarily agree to

the above stipulations and sign this Compromise Agreement on this _th day of September
2020, for the consideration of the Honorable Court.
