Scenario
You are an associate in AP Law Firm, a leading Arbitration Practice in
Jakarta, Indonesia. The Senior Partner has called you to her office. The
Senior Partner informs you that she needs you to draft a letter of advice
to a client.

The Client is PT Shanghai X. They are a major international construction

company that have several projects in the South East Asia Region. PT
Shanghai X has been a client of AP for many years. In fact, the firm has
represented the client in 3 previous Arbitration hearings in the past 5
years under BANI Rules in Jakarta.

The Client asked AP Law Firm:

The possibility of submitting an application to the Indonesian Courts to
suspend the encashment of a Bank Guarantee in Indonesia. The question
come from the fact that, in the jurisdiction of PT Shanghai X i.e. People
Republic of China, they provide the mechanism to submit the application
to suspend the encashment of Bank Guarantees.
Write a Draft letter of advice to the client for your Senior Partner’s
approval.
