Course Objectives: We have historical experience that in certain countries minorities having different script, language and religion from that of ruling majority were
subjected to not only certain disadvantages but were also forced to adopt script, language & religion of the majority class. This paper aims at sensitizing students about the
constitutional protection of the interests of minority communities in India.
Pre-requisites: The students need to have fundamental and basic knowledge of the history, religions and cultures of different minority committees and
necessity of their protection against the rule of majority community.

 Historical perspective of Minorities Law.
 Concept of Minority; linguistic and religious.
 Prohibition of discrimination on the ground of religion and language.

Module II Rights of Minorities 25%

 Minority educational institutions and two fold rights of Minorities under Article 30 relating to their educational
institutions.
 How the word ‘choice’ under Article 30 qualifies both the aforesaid rights & widens their scope?
Module III General Principles applicable to minority institutions 25%
Descriptors/Topics
 Scope of establishment and administration of Minority educational institutions under Article 30.
 Regulation of Minority institutions, permitted and non- permitted State regulations.

Module IV TMA Foundation Case 25%


 Implications of TMA Foundation case for Minority educational institutions and later developments.
 Interplay of Articles 30,26,19 (1) (g) & (6).

Course Learning Outcomes: As a result of studying this course


 The students will have better insight regarding the fine points of the constitutional protection of the interest of the minority communities in India.

Pedagogy for Course Delivery: The course will be conducted using theory and case based method. After explaining the concepts, shift would be towards
making the students aware of the various aspects of: Minorities Law through lecture, tutorials, group discussion and interaction.
