NATURE: This is a petition for review on certiorari under Rule 45 of the Rules of Court assailing
the decision and resolution of the Court of Appeals which affirms the decision of the Regional
Trial Court of Makati City.
FACTS: Josephine D. Gomez, a teller at the Domestic Airport Branch of the PCIB allowed a
certain Colin R. Harrington to opened Savings account. Two genuine bank drafts were
presented and were accepted by Josephine with the permission from her immediate
supervisor. On two separate dates, an impostor withdrew the sums of P50,600.00. The PCIB
issued a memorandum asking Josephine to explain why no disciplinary action should be taken
against her for having accepted the bank drafts for deposits. The PCIB deducted in Josephine’s
salary and ordered her to pay P50,600.00 which the bank is supposed to be liable to Harrington.
On February 10, 1986, Josephine filed a complaint for damages withprayer for preliminary
injunction before the RTC of Makati City. The PCIB filed its answer with counterclaims and a
separate complaint with the RTC of Makati City. The RTC rendered a favourable decision to
Josephine. On appeal, the PCIB argued that the RTC had no jurisdiction over the case because it
was a labor dispute, which the labor tribunals are more competent to resolve. The CA affirmed
the RTC decision and subsequently, denied the PCIB’s motion for reconsideration hence, the
PCIB filed the present petition
ISSUE: Whether or not the RTC has jurisdiction over the case
FALLO: The petition for review on certiorari is DENIED and consequently, the decision and
resolution of the Court of Appeals are AFFIRMED in toto.
