CONSTITUTION AND BY LAWS

SMCS Faculty and Staff Association

PREAMBLE

We, the members of SANTA MARIA CENTRAL SCHOOL teaching and non-
teaching staff voluntarily unite ourselves to form an association in order to promote our social
and economic well-being, protect and uphold our individual and collective rights, as well as
foster harmonious and strong relationship do hereby adopt and promulgate this constitution
and bylaws.

This constitution and bylaws is a guide of effective management for the ultimate
achievement of our goals.

ARTICLE I. NAME AND DOMICILE

Section 1. This organization shall be known as the SANTA MARIA FACULTY AND
STAFF ASSOCIATION.

Section 2. The association shall be domiciled at SANTA MARIA CENTRAL SCHOOL,


Poblacion 01,Sta. Maria, Isabela.

ARTICLE II. DECLARATION OF GOALS AND/OR OBJECTIVES

The association commits itself to the pursuit of the following:

Section 1. To promote moral, social, and economic well-being of all the members.

Section 2. To protect and uphold the individual and collective rights of all the members.

Section 3. To foster harmonious and strong relationship of all members.

Section 4. To strive for the adoption of legislation, policies, and other measure that will
promote the economic, social and general welfare among members.

ARTICLE III. MEMBERSHIP

Section 1. Every member of faculty and staff of SANTA MARIA CENTRAL SCHOOL
whether permanent or casual, regardless of gender, race and nationality, religious or political
affiliation is eligible for membership in the organization.

ARTICLE IV. PRINCIPAL OFFICERS AND TENURE OF OFFICE

Section1. The governing body of the association shall be the officers whose members shall be
elected through actual voting.

1.3. Secretary
1.4. Treasurer
1.5. Auditor
1.6. PRO
Section 2. Qualification of officers:

Any member who is holding a permanent position status is qualified to be an officer.

Section 3.The officer shall hold office for a period of 2 years per term from the date of their
election until their successors shall have been duly elected and qualified, provided that they
remain member of the association in good standing.

Section 4. When any officer from the vice-president down to the lowest position is
transferred, resigned, petitioned for incapacity to discharge duty, an outright special election
shall be made for the immediate replacement of this/these vacated position /s.

Section 5. Any officer shall not be allowed to hold office for more than 2 consecutive ------
terms.

ARTICLES V. DUTIES AND POWERS OF THE OFFICERS

Section 1. President:

 Shall act as the chief officer,


 Shall convene and chair meetings, and
 Shall call special meeting of the association or creates committee whenever he/she
deems necessary or upon written request of the majority of the general membership
and the majority of the officers to be approved by the Principal.

Note: Majority is 2/3 of the total members.

Section 2. Vice-President:
 Shall perform the duties and functions of the president in case of the latter’s absence,
disability or incapacity, or resignation.
 Shall perform functions empowered by the president.

Section 3. Secretary:
 Shall take down minutes of the meetings of the general membership.
 Shall act as a custodian of all records, documents and minutes of the meetings of the
officers of the general membership.
Section 4. Treasurer:
 Shall collect, receive and issue receipts for all money, funds and contributions to the
association.
 Make sure that all disbursement and payments made by him are accompanied by
necessary receipts.
 Keep records of all receipts and expenditures.
 Prepares such financial reports anytime as may be required.
The rendering of such account shall be made;
 Once a year.
 At such other times as may be required by a resolution of the majority of the members
of the association.
 Upon vacating his office or dissolution of the association for any cause.
Section 5. Auditor:
 Shall audit, verify and examine all financial accounts of the association.
 Shall supervise the entries in the books of accounts and shall render of his/her audit as
may be required by the majority.
Section 6. PRO:
 Shall serve as spokesperson and press information officer.

ARTICLE VI: STANDING COMMITTEES

Section 1. To ensure coordination and efficiency in the transaction of any matters, and in
order to realize the objectives and goals of this constitution, the following two (2) standing
committees are hereby created:
a) Committee on membership – Which shall receive and process application for
membership and make recommendation there in or as to whether or not the
applicant is qualified. It shall implement rules, regulations and decisions as
maybe promulgated by the general membership for the admission of the new
members.

b) Committee on grievance and welfare – Which shall hear and investigate internal
disputes in accordance with Article XII of this constitution. It shall assist in
the presentation and settlement of grievance subject for the adaption of a win-
win formula favoring both parties equally.

c) Committee on claims and benefits – which shall assess/validate documents


submitted by any member for his/her claims or benefits.

ARTICLE VII. MEETING OF THE ASSOCIATION

Section 1. The association shall hold regular meetings at least once a year. Notice of the
meeting shall be sent out by the secretary at least 5 days prior to such meeting by posting in
conspicuous places. The date, time and place for the meeting shall be determined by the
officers and the office of the principal.

Section 2. Special meetings of the general membership may be called at any time, either of
the call of the president, or upon petition addressed to the president of the majority of all the
members upon the approval of the office of the principal.

Section 3. Any member who absents himself/herself from any regular or special meeting of
the general membership shall submit an explanation to the committee on membership within
5 working days from the date of the meeting the reason for the absence. Should the member
fail to submit an explanation, a penalty of 100.00 Php shall be charged.
Section 4. Members on official leave of absence are deemed excused but may attend
meetings upon their will.

ARTICLE VIII. ELECTION

Section 1. There shall be a Commission on Election (COMELEC) to be created by the


general membership at least ten (10) working days before any regular or special election.

The Functions are:

a.) Adopt and promulgate rules and regulations that will ensure free, clean, honest,
and orderly election, whether regular or special.
b.) Examine the qualification of candidates.
c.) Rule on any question or protest regarding the conduct of the election subject to the
procedure promulgated by the general membership.
d.) Proclaim duly elected officers.

Section 2. The COMELEC shall be composed of a chairman and two members all of whom
are disqualified from running on any elective position.

Section 3. The comelec shall be automatically dissolved ten days (10) after the duly elected
officers are proclaimed.

Section 4. Regular election of officers of the association shall be held every last Thursday of
July and on the same day every three (3) years thereafter.

Section 5. Members of the association not otherwise disqualified by the constitution shall be
eligible to vote, where right to abstain is respected for acceptable reasons.

Section 6. Electing officers shall be by actual voting and the election shall be decided by
plurality of votes.

Section 7. The newly elected officers shall meet within one (1) week following their
proclamation, together with the former officers to which the outgoing administration shall
turnover all records and properties of the association to the new administration.

ARTICLE IX. FEES, FINES AND OTHER PAYMENTS

Section 1. A membership fee of 50.00 Php shall be paid to finalize membership and to avail
of benefits.

Section 2. Every payment of fees or other contribution by a member shall be evidenced by a


receipt signed by the treasurer as by making a collection and entered to the records of the
association to be kept and maintained by the treasurer for a purpose.

Section 3. The books of accounts and other records of the financial activities of the
association shall be open for inspection by any officer or member anytime during office hours
through formal/written request by the petitioner.

Section 4. Monthly due of 30.00 php shall be paid by every member of the association.

ARTICLE X. QUORUM AND RULES OF ORDER


Section 1. Except when a greater proportion is required here on, a majority vote shall prevail
at meeting and deliberations of the association. A number of ½ +1 of the total membership of
the association of the association shall constitute a quorum to officially transact any business.

Section 2. Meetings of the association, shall whenever practicable, be governed by


parliamentary rules of order.

ARTICLE XI. SETTLEMENTS OF INTERNAL DISPUTES

Section 1. Disputes/conflicts involving association members shall be made in black and white
and submitted to the grievance and welfare committee.

Section 2. The committee on general welfare shall require the respondent within five (5) days
from the date of confrontation of the parties to reduce their answers in writing. Thereafter,
both parties shall entitled to a hearing.

Section 3. The committee shall weigh impartiality the differences of claims of both parties.
However, if one of the dispute parties has a relation from the third degree of affinity or
consanguinity with any of the members of the grievance committee, the latter will abstain.

Section 4. After proper evaluation of evidence submitted, the committee renders its written
decision on disputes within five (5) days from termination of the hearing.

Section 5. Decision of the committee shall become final unless appealed to the general
membership within three (3) days from receipt of a copy of the decision of the committee on
general welfare.

ARTICLE XII. CLAIMS/BENEFITS

Each association member shall give an amount as aid to fellow member/s in case of
death.

Section 1. In case of death of a member, two hundred pesos (200 Php ) shall be given by each
member.

Section 2. In case of death of an immediate member of the family (lawful husband, wife and
children), 100 hundred pesos (Php 100) shall be given by each member.

Section 3. Any member with no beneficiaries as stated above shall declare the same subject to
validation of the committee on membership.

Section 5. Any member who retires is entitled for a one time financial assistance/support of
three hundred pesos (Php 300) from each member.

ARTICLE XIII. COLLECTIVE RIGHTS

Section 1. To attend as one association to wakes and/or interment of the member and/or any
of his/her above mentioned beneficiaries provided that same shall be approved by the
principal.

Section 2. To attend the Relax and Recreation which shall be done once a year. Failure as
such without valid reason as assessed by the committee on membership shall be subject to the
following disciplinary procedures:
First Offense – Reprimand

Second offense – First warning

Third offense – Second Warning

Fourth Offense – Termination

ARTICLE XIV. IMPEACHMENT RECALL

Section 1. Any two (2) of the following shall be a ground for the impeachment or recall of
association officers.

a. Committing directly acts against the interest and welfare of the association.
b. Malicious attack against the association, its officers or against a fellow
association officer.
c. Misconduct and unbecoming of an association officer.
d. Misappropriation of association funds and property.
e. Willful violation of any provisions of this constitution and bylaws.
f. Incapacity of officer/s to discharge his/her duties provided by this constitution.

Section 2. The following procedures shall govern impeachment and recall proceedings.

a. Impeachment or recall proceedings shall be initiated by a formal petition or


resolution signed by at least 30% of all bona fide members of the association
addressed to the committee on grievance and welfare.
b. The committee on grievance and welfare shall then convene a general
membership meeting to consider the impeachment or recall of an officer or a
group of officers whether elective or appointive.
c. The officers against whom the impeachment or recall charges have been filed
shall be given ample opportunity to defend themselves before any
impeachment or recall vote is finally taken.
d. The majority of all the members of the association shall be required to
impeach or recall officers.
e. An officer/s impeach shall “ipso facto” be considered resigned or ousted from
office and shall no longer elected nor appointed to any position.
f. The decision of the general membership on the impeachment or recall shall be
final and executory.

ARTICLE XIV. AMENDMENTS

Section 1. This Constitution and By Laws may be amended or modified in full or in part once
every three (3) years from its official issuance after the formal petition of at least 2/3 of the
general membership.

Section 2.Proposed amendments shall become part of this constitution and by-laws after
having been ratified by two-thirds (2/3) vote of all the members of the association either at
special meeting or a referendum called for such purpose.

Section 3. A law can be enacted and be part of this constitution after being presented to the
general membership and agreed by a vote of 2/3 of all the members.
Section 4. Amendments of this constitution and By Laws shall take effect immediately upon
its ratification.

ARTICLE XV. EFFECTIVITY

Section 1. This Constitution by Laws shall take effect on the day following its ratification.

Adopted and ratified this 30th day of October, 2017 at SANTA MARIA CENTRAL
SCHOOL with the list of members, together with their signatures, who ratified the same
appearing in “ANNEX A” hereof.
