AFFIDAVIT OF SEIZING OFFICER

I, xxxxx, of legal age and a bona fide member of the Philippine Drug
Enforcement Agency, Regional Office I, Lingsat, City of San Fernando, La
Union, after having been duly sworn to in accordance with law, hereby
depose and state that:

1. On September 22, 2020, Hon. Executive Judge JAKO GARCIA OF


Regional Trial Court, Branch 28, San Fernando City, La Union issued
Search Warrant No. 54321 against Mila Everyday (Mila) of Brgy.
Poblacion, Bacnotan, La Union, who is believed to be in custody and
possession of an undetermined quantity of methamphetamine
hydrochloride kept within her residence;

2. On September 23, 2020 at around 6:30 P.M, a briefing was


conducted by Team Leader COCO MARTIN at PDEA REGIONAL
OFFICE I, Brgy. Lingsat, City of San Fernando, La Union for the
implementation of the Search warrant, wherein I, xxxx was
designated as the searcher, while yyy was designated as arresting
officer and the rest of the team were designated as immediate back
up and perimeter security;

3. That during the briefing, we contacted the NPS Representative,


Media Representative and Elected Barangay Officials to witness the
implementation of Search Warrant and be at the residence of Mila at
around 7:00 P.M.;

4. At around 6:40 PM of the same date, the team left the office and
proceeded to Brgy. Poblacion, Bacnotan, La Union. Upon reaching the
target area, the team proceeded into said target house. Upon arrival,
we knocked at the door and Mila’s mother, Tita Everyday opened the
same. We requested her to call Mila and tell her about the search
warrant against her;
5. The Search warrant was read and explained in a dialect known and
understood by Mila, then in the presence of the witnesses, DOJ
Representative (ANGELIKA PANGANIBAN), Brgy. Kagawad (JOHN
LLOYD CRUZ), Elected Barangay Captain ( DERREK RAMSAY), and
Media Representative ( ELLEN ADARNA);

6. Thereafter, I gave a copy of the Search Warrant to Mila and let her
sign the original copy as a proof that she received it. Before starting
the search, I asked the barangay captain to frisk me as standard
operating procedure in the implementation of the warrant;

7. Thereafter, I, together with the witnesses, the occupants and Mila


started searching for dangerous drugs. We first searched the living
room and found a green pure gold eco bag in the closet located
therein containing white crystalline substance. I marked the same
with SVR 09232020 and signature and let the designated
photographer in the person of Agent JOSEPH MARCO to photograph
the same while I am marking it;

8. We continued the search inside the house of Mila but nothing was
found. I then asked the arresting officer, ILYN VIERNES to effect the
arrest of Mila. Thereafter, agent I. VIERNES declared the arrest of
Mila and immediately apprised her of her constitutional rights in a
dialect known and understood by her;

9. At the end of the search, I prepared the Certificate of Inventory,


Certificate of Conduct of Orderly Search and Barangay Certification in
the presence of DOJ Representative (ANGELIKA PANGANIBAN), Brgy,
kagawad (JOHN LLOYD CRUZ), Elected Barangay Captain ( DERREK
RAMSAY), media representative (ELLEN ADARNA);

10. After the marking, photographing and inventory, I secured the


piece of evidence, we then, together with the arrested suspect
proceeded to Regional Office I, Brgy. Lingsat, City of San Fernando,
La Union for the preparation of the Return of the Search Warrant
with Motion to Take Custody of the Drug Evidence Seized which shall
be submitted to the issuing court;
11. I personally showed the piece of evidence to the issuing court
with Motion to Take Custody of the Drug Evidence Seized which was
granted by the said court. We then returned in our office, Philippine
Drug Enforcement Agency, Regional Office I, Brgy. Lingsat, City of
San Fernando, La Union, and I prepared a request for Laboratory
Examination of the seized piece of evidence to PDEA ROI Laboratory
Section, which turned out to be positive for Methamphetamine
Hydrochloride also known as Shabu under Chemistry Report No.
PDEA-RO1-20-888 with a weight of 10,0888 grams;

12. Mila was also brought to Ilocos Training and Regional Medical
Center, McArthur Brgy. Parian, San Fernando City, La Union for
Physical and Medical Examination;

13. I am executing this affidavit to attest to the truth of the


foregoing facts and circumstances and to support the filing of a
criminal complaint against Mila Everyday for violation of Section 11
Posession of Dangerous Drugs of Article II of RA 9165 otherwise
known as “The Comprehensive Dangerous Drugs Act of 2002”.
