Opening: Meeting called to order in the break out room

during class and an extended meeting after the
end of the class. Quorum was established.

Agenda: To discuss the inherent power of the state for

what provision, nature, scope definition or
exemption of each power we want to change,
amend, alter, or delete.

Discussion: Police Power:

 Villahermosa open up the idea on NSTP
that the police lice power of the state
may include the Out of School Youth to
be use as extra man power or to serve
community serves as this inherent power
so broad it may happen as he speak. He
also added that a mandatory refresher
unit must be added in miranda rights in
order to the remember the rights of the
people.

 Melecio open up about delegation of

powers. He state that a case at bar
mentioned, A delegated power may not
be further delegated. He added an
example that the power of one branch
such as LTO cannot be delegated to
other branch like PNP just to limit
violations on motor vehicles.

 Cozido commented as the police power

vested to the PNP for public safety they
are authorized to caught a person by
warrantless arrest by not violating the
miranda rights of the person. However,

 Minalabag discuss that the police power
of the state has the power to stop or may
confiscate if it will cause harm to the
people such as gambling. As she
continues that this must be stop a it has
no benefit gives to the people and also
the night club which she sees that it
didn’t give good to the public.

 Yapao open up that in violation of curfew

is this will not affect the constitutional
right of the person that everyone has the
right of freedom of movement and
residence within the borders of each
state. He add that curfew that prohibits
the public to move freely in which the
constitution gives right to everyone has
the right to freedom movement.

Eminent Domain:
 Melecio open up the compensation must
be fair that it must not be compensated
not just the fair market value but they
must include the value of the crops to be
gain in coming years.

 Villahermosa added that the

compensation they must consider also
the future uses of the land in which they
will pay the gain the whole 5years.

 Cozido added that the fair market value

must be computed at the time of the
taking in order to be fair to the owner.

Taxation:
 Villahermosa discusses the separation
of church and state must be remove.
Churches should not be exempt from
taxes even for those religious purpose.

 Melecio discusses the removal of VAT
on basic need that it will only applicable
to product that are for leisure’s only. That
the government must alter and put a
prices ceiling that VAT must be
implemented.
 Minalabag discusses to lower minimum
corporate income tax in order to invite
foreign investors as they see that they
will gain more profits due to low
corporate income tax.
As we gather the ideas to select which we will
change in Police power we select the idea on
delegation of power, why this entity tolerate
such doing. In Eminent Domain we choose the
idea on fair market value in terms of
compensation that it must be alter.
In Taxation we chooses to alter the VAT
exemption.
