AFFIDAVIT OF PARAPHERNAL/EXCLUSIVE PROPERTY

sworn in accordance with the law, do hereby depose and say that:

1. I am legally married to _____________________________, of legal age, Filipino, and

with present address at _____________________________________, but however,
have been already separated-in-fact from him for more than _________ (___)
years;

2. I purchased a real property from __________________, covered by TCT No.

_________________, located in ___________________________, measuring
________________ square meters, more or less;

3. The funds which I used to purchase the said real property, do not form part of
our absolute community property or conjugal partnership, but were taken from
my own personal, paraphernal, exclusive and separate money;

4. I was able to afford the said property out of the fruits of my own industry;

5. Therefore, pursuant to Article 109, Section 2 of the Family Code of the

Philippines, I have exclusive rights to sell, mortgage, encumber, alienate, or
otherwise dispose of the said real property even without the marital consent of
my estranged husband;

6. I am executing this Affidavit of Paraphernal/Exclusive Property to attest to the

truth of the foregoing facts and for all legal intents and purposes, and to
request the Registry of Deeds to cause the annotation of the same at the back of
TCT No. ______________;
