Choi vs. Kwon Yongtae,” docketed as NPS No. XV-13-INV- 16E-01050 (the instant “Criminal Complaint”). 2. After thoroughly examining and reviewing respondent Kwon Yongtae’s Counter-Affidavit dated 23 August 2016, I realized that the ground, upon which the instant Criminal Complaint was based, was merely the result of misunderstanding. 3. Having realized the foregoing, I am no longer interested in pursuing the instant Criminal Complaint and I am desisting from further prosecuting the same against respondent Kwon Yongtae. 4. Tam executing this Affidavit of Desistance to attest to the truth of the foregoing facts and to give authority for the dismissal with prejudice of the instant Criminal Complaint.5. I further acknowledge that this Affidavit of Desistance was made willingly and voluntarily and with full knowledge of my rights under the law.
