FACTS:

Rita Tapnio was indebted to PNB. She failed to pay despite the demands. She did not consider herself
indebted to PNB because she had an agreement with one Jacobo-Nazon whereby she had leased her
unused export sugar quota with PNB’s knowledge. PNB placed obstacles to the consummation of the
lease, and these forced Nazon to rescind the lease contract. Thus, Rita filed her third-party complaint
against PNB to recover any and all sums of money which may be adjudged against her and in favor of
the plaintiff plus moral damages, attorney’s fees and costs.
