Release and Waiver of Liability

6348 N Azalea Ave. San Bernardino, CA 92407 (“Releasee”), which affects your legal rights, so please
read carefully.

The Releasor desires to rent from Releasee equipment to be used by Releasor, his/her guests, invitees or
other persons while in Releasor’s possession, Releasor understands that use of this equipment may, by
its nature, cause injury or harm to Releasor, his/her guests, invitees, or other persons.

The Releasor does hereby freely, voluntarily, and without duress executes this Releasee under the
following terms:

1. Waiver and Releasee: THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS

EITHER EXPRESSED OR IMPLIED. Releasor understands and acknowledges that this Release
discharges Releasee from any liability or claim that the Releasor may have against Releasee with
respect to any bodily injury, personal injury, illness, death or property damage that may result
from Releasor’s use and possession of Releasee’s equipment. Releasor does hereby release
and forever discharge and hold harmless Releasee and its successors and assigns from any and
all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise
or may hereafter arise from Releasor’s possession and use of Releasee equipment.
2. Insurance: Releasor understands that insurance for liability, health, and medical or disability
coverage in any way related to the rental of equipment under this agreement is the sole
responsibility of Releasor.
3. Indemnification: Releasor agrees that he/she will indemnity and hold Releasee, their principals,
officers, owners, employees, and equipment & supplies manufactures harmless from any liability
resulting from the use of Releasee equipment by Releasor, hi/hers assigns, heirs, guests, invitees
or other person using the equipment while in Releasor’s possession.
4. Other: Releasor expressly agrees that this Release is intended to be as broad and inclusive as
permitted by laws of the State of California and that this Release shall be governed by and
interpreted in accordance with the laws of the State of California. Releasor agrees that in the
event that any clause or provision shall not otherwise affect the remaining provisions of the
Release, which shall continue to be enforceable.
