When physical impurity falls into any [type of] of still water, wudu Is not permitted with it, be

[that water] less or more [in quantity], because the Prophet SAW as instructed [us] to protect
water from impurity for he (SAW) said:
“None of you should ever urinate in standing water, and neither should be bathe in it
for [the removal] of janabah (major ritual impurity)”

He (SAW) also said: “Whenever any of you wakes from his sleep, he must not dip his hand into
the pot [of water] until he has washed it three times, for he does not know where his hand
spent the night.” (Muslim, Abu Dawd, An Nisaai, Ibn Majah, Ahmad, Ad Daraqutni)

 Imam Malik: water will not be impure until 1 of the 3 wasf/qualities change
o Daleel: al ma’au tuhuran laa yanjisu shaian – water is pure and nothing makes it impure (whether
less or more)
 Ahnaaf Reply: Daleel – hadith Mubarak “la yabulanna” –
o Nabi saw has ordered not to do ghusul janabah or urinate in still water, though neither of the two,
smell or taste very dramitally
o So if water is never impure, then why would Nabi SAW stop us?
 Your Daleel is about well/spring water running in the garden, so this cannot be taken as standing water
 Ahnaaf Daleel 2 – Hadith: “iza istaiqadah ahadukum min manamihi…” – The riwayah says to not put the
hands in water pot after we wake up. Till we wash them first,
o this is because of the fear of not knowing if or not the hands wandered at night and have najasah on
them
o the purity is that water remains purity from every form najasah
 Aimmah Thalatha – najasa falls it will be mutlaqan impure
o even if neither of the wasf/qualities change in maa qaleel and in maa katheer
o if one wasf overwhelms the water
- there is an ikhtelaaf amongst aimma thalatah as to how much is considered maa katheer and maa
qaleel (large quantity/less quantity of water)
