Equity, Social Justice, and Inclusivity Issues Related to Functional Area

“The Association for Student Conduct Administration (ASCA) applauds legislation that
seeks to better protect and educate students and student-led organizations with regards to
campus sexual misconduct and sexual assault, as well as legislation that promotes clearer,
more effective policies and procedures for higher education institutions to engage with
local law enforcement. While ASCA encourages legislation that empowers and supports
the ability of colleges and universities to utilize best practices in student conduct
administration, certain aspects of the Safe Campus Act (H.R. 3403) and the Fair Campus
Act (H.R. 3408) interfere with long-established student conduct procedures that ensure
every student’s case can be addressed fairly and respectfully. Not only do these bills
conflict with Title IX, they will significantly hinder institutions’ abilities to properly
investigate and respond to potential threats on campus and enable full attorney
representation of individuals and organizations in the student conduct process.”
