On 9 October 2020, the undersigned personally served to the defendant
Elmer MoRte the Writ of Execution dated 29 September 2020 and demanded him to comply with the terms and conditions entered into the Compromise Agreement dated 22 October 2018 and he informed me that he turned over the Two Hundred Fifty (250) square meters Lot and the plaintiffs already took possession on 11 March 2020 as agreed in exchange for the portion of property where the ancestral house of the defendant have occupied in the plaintiff’s property. I then notified him of the compliance as stated in the said Compromise Agreement to respect the outcome of the survey report which was conducted on XXXXX by XXXXXX which specified that he has encroached and fenced a 7,318 square meters portion of lot inside the plaintiff’s property, but he insisted that he does not trespass inside the plaintiff’s land and that the existing fences were within his property. As the undersigned have no further action but to only notify the defendant with regards to the encroachment issue, the original copy of the Writ of Execution is respectfully returned and now considered FULLY SATISFIED.
