DECLARATION OF HEIRSHIP WITH DEED OF ABSOLUTE SALE OF LAND

KNOW ALL MEN BY THESE PRESENTS:

That We, FELICIANA LERIO and NANCY B. ENRIQUEZ, both widow, resident of
Atabay, Ayungon, Negros Oriental, Philippines, and on the other hand, LELIBETH
COLONGON, of legal age, single, Filipino, resident of Atabay, Ayungon, Negros Oriental,
Philippines, hereinafter called as the VENDEE.

W I T N E S S E T H:

THAT the herein heirs-vendors are the legal heirs of late ALICIO BAJA, who is a
registered owner of a parcel of land as evidenced by OCT No. FV-4795, known as Lot 652,
Pls-666 located at Atabay, Ayungon, Negros Oriental, containing an area of 20,909 square
meters, more or less.

THAT the area subject of this sale is a portion of the above land and was
particularly described and bounded as follows;

LOT NO. 652-N (Portion of Lot No. 652, Pls-666)

“A parcel of land Lot No. 652-N being a portion of Lot 652, Pls-666, located at
Atabay, Ayungon, Negros Oriental, under OCT No. FV-4795 in the name of Alicio Baja.
Bounded on the North by the remaining portion, 12.30 m, on the East by Lot 652-J,
26.20 m, on the South by remaining portion of Lot 652, 12.50m on the West by Road
right of way, 25.50m, containing an area of THREE HUNDRED SIX (306) square
meters, more or less.”

That said ALICIO BAJA, died long time ago leaving no will nor testament and no
known debts whatsoever and upon his death the above-described property was survived
by the above legal heirs.

Invoking the provisions of Section 1 of Rule 74 of the Rules of Court the herein
Heirs by mutual understanding among themselves hereby adjudicate unto themselves the
above parcel of land.

That for and in consideration of the sum of TWENTY FIVE THOUSAND PESOS
(P25,000.00), Philippine Currency, receipt in full is hereby acknowledged by the HEIRS –
VENDORS to their full satisfaction from the VENDEE, the former by these presents, do
hereby SELL, TRANSFER and CONVEY unto the latter, her heirs, successors and assigns
the above-mentioned property, with all the improvements contained therein, unto and in
favor of the herein vendee, free from all liens and encumbrances.

That this land is not tenanted nor there is an agricultural lessee found within the
premises as the vendee is now in actual possession of the said land and this instrument is
not executed to evade the CARP Law.

That the provisions of Article 1621 and 1623 of the New Civil Code of the
Philippines were duly complied with as the adjoining owners and possible redemptionists
were duly notified with the transaction but they express no desire to redeem the land
subject of the sale.
That the parties hereby agreed to register this instrument in accordance with the
provision of Article 496 known as Land Registration Law, in the Register of Deeds of the
Province of Negros Oriental.

IN WITNESS WHEREOF, we have hereunto set our hands this

BEFORE ME, this ____________ at Bindoy, Negros Oriental, Philippines,


personally appeared the above affiants with their respective valid identifications reflected
below their names, both known to me to be the same persons who executed the foregoing
instrument and they acknowledged to me that the same were their free acts and voluntary
deeds.

This instrument is consist of two (2) pages including this page wherein the
acknowledgment is written signed by the parties and their instrumental witnesses on each
and every page thereof.
