PRELIMINARY STATEMENT

The person examining me is JESSON P. MACAPAL with law office address

Salinas Drive, Lahug, Cebu City. My Judicial affidavit is being taken at the above
mentioned place. The questions are asked in the English Language but are
translated in the Tagalog dialect which I speak and fully understand and I am
giving my answers fully conscious that I do so under oath and I am aware that I
may face criminal liability for false testimony or perjury for false statements made
or given by me.

OFFER OF TESTIMONY

The testimony of the witness Jimboy G. Macapal is being offered to prove he

is an eye witness to the crime of Robbery. He will testify what he saw the day with
the accused dated On October 15, 2020.
The witness will state where they exactly are when the crime is happen or
committed.

1. Q: Mr. Witness, will you please tell the Honorable Court your name, age,
and other personal circumstances?
A: I am Jimboy G. Macapal, 28 years old, a service crew and a resident of
A.S. Fortuna St, Mandue City, Cebu.
2. Q: What is the nature of your work?
A: The nature of my work is giving service to the customer and satisfy them the
the services they need.

3.Q: How long you’ve been working?

A: I’ve been working for almost 5 years.

4. Q: How do you know Ryan G. Millan the accused?

A: He is one of my friend and a co-worker in a fast food as a service crew.

5. Q: Do you have any relationship with the accused?

A: We were friends since before we got the job as a service crew.

6. Q: How long have you been working with the accused?

A: We've been working for almost 5 years.

7. Q: Can you describe the accused as your co-worker?

A: Ryan G. Millan as my co-worker is a very responsible man, he did his job
accordingly and kind to the customers.

8. Q: On October 15, 2020 at your work did the accused been there until the shift
was done?
A: Yes, Sir.

9: Q: Where were you on October 15, 2020 at around 4:35 in the morning?
A: On October 15, 2020 at around 4:35 Ryan Millan and I were still doing our
task caygo “clean as you go”.

10. Q: In connection to this case do you remember having executed a sworn

statement?
A: Yes, Sir.

Your honor, we would like to give our opening statement, this is a case of mistaken
identity on the Evening of October 15, 2020 my client Ryan Millan was at his work
at Sulirap Eatery and doing his job with his co-workers. He was not in the said
place where Mr. Ryan Gevera was assulted and rob. Today we will hear from two
defense witnesses Ryan Millan and Jimboy Macapal. We anticipate that mr Jimboy
Macapal will describe that on October 15, 2020 at around 4:35 he and Defendant
Ryan Millan was doing there task the “caygo”. Your Honor we would like to ask a
verdict of not guilty.

Your Honor may i present the 1st witness for the defense.
