AFFIDAVIT OF DESISTANCE

I, Maria Feliz de Jesus Archangel, of legal age, single and a resident of #143 Block 4
Lot 60, San Rafael Street, Barangay Gabriel, GMA, Cavite , after having duly sworn to in
accordance with law hereby depose and state:

1. I am the complainant/ aggrieved party for Reckless Imprudence resulting to Physical

Injury with Abandonment against URSINO MENDOZA MERCADO III, in the case
entitled “People of the Philippines vs. URSINO M. MERCADO III, with Criminal
Case No. 16-211, Regional Trial Court Branch No. 276, City of Muntinlupa.

2. The complaint was the result of a vehicular accident which occurred last November
26, 2015 when I was hit by the motorcycle owned and driven by the respondent on
the case URSINO MENDOZA MERCADO.

3. THAT, after a careful deliberation over what happen, I am fully convinced that the
same arose to be purely accident causing without fault or negligence on the part of the
driver, URSINO MENDOZA MERCADO.

4. THAT, after a sober assessment and analysis of the incident I have realized that the
driver, URSINO MENDOZA MERCADO did not abandon me and his
responsibilities to me, in fairness to him.

5. THAT, in view of the foregoing, I hereby confess, declare and manifest my absolute
lack of interest in and permanent desistance from filing any lawsuit whether criminal,
civil or administrative arising out from the said incident.

6. I likewise request the Regional Trial Court Branch No.276 to dismiss with prejudice
the said criminal case.

IN WITNESS WHEREOF, I hereby set my hand this 21st day of March 2016 at City of

Re: WITHDRAWAL OF CASE

Dear Sir;

Greetings!

Please be informed that I, Mara Feliz de Jesus Archangel, the complainant on the criminal case
Reckless Imprudence Resulting to Physical Injury with Abandonement particularly described as
Criminal Case No. 16-211 entitled as “People of the Philippines vs. Ursino M. Mercado III”,
respectfully move and request before the Office of the City Prosecutor, to allow the withdrawal
of the above mentioned case and to free the respondents, URSINO MENDOZA MERCADO III,
in any liability whether criminal, civil or administrative.

The withdrawal of the cases mentioned above is herein with the understanding that both parties
are with the agreement to settle the differences off court.

The agreement between the parties involved to withdraw the case filed is not in contrary to laws,
moral or public policy and order.

Let this manifestation to withdraw the case mentioned above be noted.
