Medecins du Monde- France (MdM) – Non-Governmental Human Organisation -
registered in Yemen, Al Areesh area next to Al Areesh school, khourmakser, Aden, whose
has signed a principal cooperation agreement with the Yemeni Ministry of Planning and
International Cooperation on January 9, 2009, and represented by General Coordinator, of
MDM in Yemen.

6. Description of the contract
Under the project of emergency medical assistance for host and displaced population
affected by the current crisis in Yemen funded by GMOFA. MDM will be providing and
delivering medical equipment to five health facilities in Lahj & Abyan governorates.

TERMS OF PARTICIPATION

8. Eligibility and rules of origin


Participation in tendering is open on equal terms to any natural and legal persons or
company.
A declaration stating the country of origin of the tendered supplies must be provided at the
time of submission of the tender. The approximate date of production of the product must
also be stated.
Tenders that do not include the above declaration will be automatically rejected.

9. Grounds for exclusion


A tenderer that doesn’t respect the good business regulation and especially guilty of:
fraud, active corruption, collusion, coercive practices, bribery, involvement in a criminal
organisation, immoral Human Resources management (non exhaustive list) will be
excluded from the market.

10. Number of tenders


Tenderers (including firms within the same legal group, other members of the same
consortium, and sub-contractors) may submit one or more tender(s) for one or more lots.
Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it
would offer a discount in the event that its tender is accepted for more than one lot.
Tenderers may submit a tender for a variant solution in addition to their tender for the
supplies required in the tender dossier.

11. Tender guarantee


Tenderers must provide a tender guarantee of amount to be specified within 2% of the
budget available for the contract / specify separate lots where necessary when
submitting their tender. This guarantee will be released to unsuccessful tenderers once
the tender procedure has been completed and to the successful tenderer(s) upon
signature of the contract by all parties. This guarantee will be called upon if the tenderer
does not fulfil all obligations stated in its tender.

12. Performance guarantee
The successful tenderer will be asked to provide a performance guarantee of 5 % of the
amount of the contract at the signing of the contract. This guarantee must be provided no
later than 30 days after the tenderer receives the contract signed by Médecins du monde
If the selected tenderer fails to provide such a guarantee within this period, the contract
will be void and a new contract may be drawn up and sent to the tenderer which has
submitted the next best compliant tender.

13. Information meeting and/or site visit


An optional information for site visit will be done for some bidders after receive bids,
details and contact for site visit to be specified on time.

14. Tender validity


Tenders must remain valid for a period of 45 days after the deadline for submission of
tenders.

15. Period of execution and delivery.


The period for execution, delivery, installation and training will start from 3 January 21 until
15 January 21, to all targeted health facilities in Lahj & Abyan governorates.

17. Award criteria
According to the selection criteria, price, quality and conformity to technical standards and
if appropriate, experience & capability of the provider, in addition to financial competency.
This tender may be awarded to one or more supplier according to the specialization and
categorize of the medical equipment.

18. How to obtain the tender dossier


The tender dossier is available for collection from Medecins du monde office in Aden.
Tenders must be submitted using the standard tender form included in the tender dossier,
whose format and instructions must be strictly observed.
Tenderers with questions regarding this tender should send them in writing to
procurement.yemen@medecinsdumonde.net (mentioning the publication reference
shown in item 1) at least 15 days before the deadline for submission of tenders given in
item 19. Medecins du monde must reply to all tenderers' questions at least 10 days before
the deadline for submission of tenders.
