PETITION

COMES NOW, the Petitioner, through the undersigned counsel and unto this
Honorable Court respectfully states that:

1) Petitioner is of legal age, married, and a resident Baquiran Street, Linao Norte,
Tuguegarao City, where she may be served with notices, orders, resolutions and
court processes;

2) Respondent Local Civil Registrar of Baggao, Cagayan is the repository of records

of birth in Baggao, Cagayan whose office is located at the Municipal Hall, San
Jose, Baggao, Cagayan;

3) That the petitioner has been a bona fide resident of the Province of Cagayan since
birth up to this time;

4) That the fact of birth of EDITH Q. DURUIN was registered on 21 December 1976
at the Local Civil Registrar of Baggao, Cagayan bearing Local Civil Registrar No.
1221. A copy of her Birth Certificate issued by the Philippine Statistics Authority
(PSA) is hereto attached as Annex “A”;

5) That there are misspelled and omitted entries in the Birth Certificate of EDITH Q.
DURUIN, which are as follows:

a) The petitioner’s First Name was erroneously entered as “EDITHA”

instead of “EDITH”;

b) That petitioner’s middle name “QUIBOL” was omitted on the space

provided for middle name;

c) That petitioner’s surname was misspelled as “DURWIN” instead of

“DURUIN” which is the correct spelling of her surname;

d) The middle name “PALAD”, of petitioner’s father, was also omitted on the
space provided therefor;

e) The surname of petitioner’s father was also misspelled as “DURWIN”,

instead of “DURUIN”;
f) The middle name “PEŇALBER”, of petitioner’s mother, was also omitted
on the space provided therefor;

6) The petitioner EDITH Q. DURUIN, (now EDITH Q. DURUIN-NARAG which is her

married name), whose parents are Jose Duruin and Luz Quibol of Centro, Baggao,
Cagayan has always used EDITH as her first name, in all her public and private
dealings. Attached as ANNEXES “B”, “C”, “D”, “E”, and “F” are copies of her
Baptismal Certificate, College Diploma at St. Louis College of Tuguegarao, her
Transcript of Records at the Philippine National Police Academy (PNPA), her PNP
ID, and her Driver’s License;

7) The middle name of petitioner is “QUIBOL” but this was omitted on the space
provided therefor in her Birth Certificate. This can be proved by the Birth Certificate
of petitioner’s mother LUZ PEŇALBER QUIBOL. Attached as Annex “G” is the
Birth Certificate of petitioner’s mother;

8) The correct spelling of petitioner’s surname is “DURUIN”, and not “DURWIN”.

Attached as Annex “H” is the Birth Certificate of petitioner’s father JOSE PALAD
DURUIN;

9) On the Birth Certificate of the petitioner, the middle name “PALAD” of her father
JOSE PALAD DURUIN was omitted, on the space provided therefor. The Birth
Certificate of petitioner’s father (ANNEX “H”) readily proves that his middle name
is PALAD his late mother’s name being HERMINIGILDA PALAD;

10)Meanwhile, in petitioner’s Birth Certificate, the middle name “PEŇALBER” of

petitioner’s mother LUZ PEŇALBER QUIBOL, was also omitted on the space
provided therefor;

11)That there is a need to correct the erroneous entry and misspelled entries on the
Birth Certificate of the petitioner, particularly, to wit:

a. Her first name from “EDITHA”to “EDITH”;

b. Her surname from “DURWIN” to “DURUIN”; and
c. Her father’s surname from “DURWIN”to “DURUIN”.

12)Further, there is a need to intercalate the omitted information/entries on petitioner’s

Birth Certificate particularly :

a. Petitioner’s middle name which is “QUIBOL”;

b. Her father’s middle name which is “PALAD”; and
c. Her mother’s middle name which is “PEŇALBER”

13)That this petition is filed in order to straighten petitioner’s record of birth and to
avoid confusion as to the record of birth of EDITH Q. DURUIN (now, EDITH Q.
DURUIN-NARAG);

14) This is not filed to avoid any criminal prosecution or any obligation of whatever
nature. Attached as Annexes “I” and “J”, respectively, are copies of the NBI
Clearance and Police Clearance of the petitioner.

WHEREFORE, it is respectfully prayed of the Honorable Court to order the

correction of the following entries in the Birth Certificate of EDITH QUIBOL DURUIN
recorded at the Local Civil Registrar of Baggao, Cagayan under Local Civil Registrar
No. 1221, particularly:

a) The petitioner’s First Name from “EDITHA”to “EDITH”;

b) The intercalation of petitioner’s middle name which is “QUIBOL”;
c) The spelling of petitioner’s surname from “DURWIN” to “DURUIN”;
d) The intercalation of the omitted entry as to the middle name of petitioner’s
father which is “PALAD”;
e) The spelling of petitioner’s father’s surname from “DURWIN” to “DURUIN”;
and
f) The intercalation of the omitted entry as to the middle name of petitioner’s
mother which is “PEŇALBER”.

Other forms of relief just and equitable under the premises are likewise prayed
for.

Tuguegarao City, Cagayan, after having been duly sworn in accordance with law, hereby depose and state that:

1) I am the Petitioner in the above-entitle case;

2) That I caused the preparation of the foregoing Petition for the correction of my Birth Certificate;
3) I have read the same and the contents thereof are true, based on facts and authentic documents;
4) That the foregoing is not filed to harass, cause unnecessary delay or needlessly increase the cost of
litigation;
5) That the factual allegations therein have evidentiary support.
6) I have not commenced any similar petition in any other court , body or tribunal involving the same case of
similar issue;
7) Should I, hereinafter learn of the existence of any pending petition involving the same case of similar nature,
I undertake to inform this Honorable Court within five (5) days from knowledge thereof.
