MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is made and entered into by:
The PALAWAN STATE UNIVERSITY with office address at Tiniguiban Heights,
Puerto Princesa City, Palawan: represented herein by DR. RAMON M. DOCTO,
President, of legal age, Filipino, married and hereto referred as “PSU”, and
The PARENTS TEACHER COUNCIL of PSU-CCRD Taytay with office and
postal address at Poblacion, Taytay, Palawan, represented by its PTC President,
Mayola D. Felizarte, of legal age, married, Filipino and with the same postal address,
herein referred to as the council.
And between
The MUNICIPALITY OF TAYTAY, Province of Palawan; represented herein by
HON. CHRISTIAN V. RODRIGUEZ, municipal mayor, of legal age, Filipino, married as
per authority of the Sangguniang Bayan in its Res. No. 089-201, dated October 29,
2013 herein referred to as Municipal.
WITNESSETH That:
Whereas, The Municipality inquest of its desire and thrust of providing one of the
basic services for the benefit of their constituents, as mandated under the RA 7160
otherwise known as the Local Government Code of 1991, which is the provision of the
quality education.
Whereas, the PSU and the Municipality have upheld for the continuity and
unhampered operation of Taytay Campus, and hereby make provision undertaking.
NOW THEREFORE, for and in consideration of the foregoing premises, the
PARTIES hereto agreed and make stipulation on the following terms and condition.
Section 1. Obligation of PSU. The PSU shall:
1.1 Take charge of the administration and supervision of Taytay Campus, and
the recruitment of qualified faculty and support staff.
1.2 Assist in sourcing out funds for the internal operation of the Campus.
1.3 Take charge on the implementation of the collection of fees and
disbursements of funds based on DBM rules and regulation, and shall submit
records of disbursements of its financial assistance within thirty (30) days from the
end of fiscal year to the Municipality.
1.4 The PSU shall collect additional special assessments fee for each student at
a rate approved by the Board of Regents. The additional special assessments fees
collected shall be turned-over to the Parents-Teacher Council to be utilized in the
procurement of the library books, and for other operation purposes approved the
duly Parents-Teacher Council Board of Directors.
1.5 Adopt and implement socialized scheme of tuition fees for greater access to
poor but deserving students.
 1.6 Set policies on admission and graduation of students.
1.7 Award honorary degrees upon person in recognition on their outstanding
contribution in the fields of education, publics service, arts, science and
technology or in any field of specialization within the academic competence of
the university and to authorize the award of non-degree and non-traditional courses.
Section 2. Obligation in the Municipality: The Municipality shall:
2.1 Allocate the amount of ONE MILLION TWO HUNDRED (Php 1,200,000.00)
for every fiscal year as aid for the salaries and benefits of the faculty and staff
members pursuant to resolution Number 089-2013.
2.2 The MUNICIPALITY shall provide the school site, building, classrooms,
library laboratory facilities, furniture, textbooks, equipment’s, supplies and
materials necessary for the establishment and continuous operation of the
CAMPUS.
2.3 That the amount allocated shall be released by the MUNICIPALITY through
its Municipal Treasurer on equal quarterly installments.
2.4 That the MUNICIPALITY commits itself to provide additional funds to be
taken from its Supplemental Budget (subject to the availability of funds), to meet the
other requirements of the CAMPUS;
2.5 The MUNICIPALITY shall not cause the establishment of another tertiary
educational institution, within its jurisdiction, offering the same course offered
by PSU.
Section 3. Final Provision. In the event that a certain circumstances or conditions not
covered by the stipulations provided above shall arise and, as such there is a
need to either amend this MOA or to merely discuss and resolve the implications
thereof the knowledge may communicate the same to the other party and call for
conference from the purpose above mentioned.
Section 4. Effectively. This MEMORANDUM OF AGREEMENT shall take effect on the
date of signing thereof by parties and shall remain in full force and subsisting
with the PSU Taytay Campus existence and even after the term of terms of the
contracting parties; thus continuity on this undertaking should be recognized and
uphold of whoever is in the administration.
