AFFIDAVIT OF WITNESS
(NPS DOC NO. XII-07-INV-18I-00406)

I, RIKEN B. DACA, 30 years old, married, Filipino and a

resident of Purok Molo B, Brgy. Libi, Malapatan, Sarangani Province,
after having been duly sworn to in accordance with law, hereby
depose and state;

2. That, herein affiant vehemently denied the accusations

leveled against SORIANO SINGCALA, BAJO KAPITAN and ARMANDO
SINGCALA by JOVIE JANE MENTAL AROY for Violation of Article VI
Other Acts or Abuse of RA 7610 and Frustrated Murder In Rel. to RA
&610 in NPS DOC NO. XII-07-INV-18I-00406 and VICTOR MALADIAN
AROY for Attempted Murder and Physical Injury in NPS DOC NO. XII-
07-INV-18I-00407, as they are patently baseless, fabricated and
defamatory. The true narration of facts are as follows;

3. That, I am the Purok Kagawad of Purok Molo B, Brgy. Libi,

Malapatan, Sarangani Province where both parties are residing. I was
one of the Purok Officials who witnessed the incident.

3. That, on 15 September 2018 around 10:30 in the evening, I

was inside our house when I heard a noise coming from a
motorcycle. I went outside our house to check it then I saw Purok
Chairman, Maramba Maladian, approaching Armando Singcala. Purok
Chairman, Maramba Maladian, told Armando “Nganong gipugaan mo
man ng imo motor?” Then Armando replied, “Gitestingan lang nako
kay sige’g short ang kuryente sang akong motor. Gapalong-palong sa
dalan. Pasaylu-a lang ko Chairman.” Then Victor Aroy arrived with his
son, Gerald Singcala and his son-in-law, Warren Basino. Victor Aroy
then shouted “Hambog kayo ka!” towards Armando Singcala. Victor
Aroy immediately threw a punch to Armando which caused him to fall
on the ground. Afterwards, Victor Aroy, Gerald Singcala and Warren
Basino surrounded Armando and punched and kicked him
simultaneously. Soriano Singcala, brother of Armando Singcala, was
going towards Armando when he was suddenly punched by Victor
Aroy in his forehead which caused Soriano to fall on the ground.
Kaito Masanda then arrived and held Soriano’s hands. Afterwards,
Victor Aroy then punched Soriano hitting his face and body. Gerald
Aroy and Warren Basino who were hitting Armando that time

transferred to Soriano and helped Victor Aroy in punching and kicking
Soriano. Victor Aroy then left and when he returned he was already
holding a weapon called “lagaraw”. Kaito Masanda who was still
holding Soriano Singcala’s hands pushed Soriano which caused him
to escape and ran towards his mother’s house. Victor Aroy was
approaching Armando Singcala and was about to strike the “ lagaraw”
to the latter then Bajo Kapitan suddenly approached and protected
Armando by trying to get the “lagaraw” but his left hand was hit.
Afterwards, Jovie Jane Aroy and Gerald Aroy tried to pacify their
father who was already out of control. Jovie Jane went in front of his
father who was holding a “lagaraw” while Gerald tried to grasp his
father at the back. All those times, even if I want to help but my
wife and my mother in law prevented me.

4. Despite Jovie Jane’s plea to stop his father, Victor Aroy, kept
on insisting showing his intent to kill Armando Singcala by saying
“Patyon jud taka kay naa koy dumot sa imoha!” Gerald and Jovie
Jane tried to pacify their father who was really out of control. Jovie
Jane still tried to stop his father but to no avail. Jovie Jane who
looked in pain then told her brother, Gerald Aroy, “Popoy, naa na koy
samad.” After several minutes, Brgy. Kagawad, Irene Maguan
Singcala, arrived. When Brgy. Kagawad, Irene Maguan Singcala, tried
to take the “lagaraw” from Victor Aroy, he refused. Aftewards, Brgy.
Captain and some Brgy. Officials came. They tried to take the
“lagaraw” to Victor Aroy but still, he refused.

4. That all the allegations of the private complainants and their

witnesses were all fabricated, spurious and motivated by ill will. The
whole story was all made up trying to twist what really transpired
during that time. The truth is Soriano Sangcala, Bajo Kapitan and
Armando Singcala were the real victims in the instant case.

5. Moreover, the private complainants’ witness, Beroy Dianda

Lambaran, a Purok Kagawad, was not in the place of the incident
during that time. I never seen him nor he responded in the incident.

7. Thus, I hereby execute this counter affidavit to attest to the

truth of the foregoing facts and circumstances, and to pray for the
outright DISMISSAL of this case.

8. IN WITNESS WHEREOF, I have hereunto set my hand this
