Description of Information Sought


Trademarks, copyrights, and patents protect different types of intellectual property.
A trademark typically protects brand names and logos used on goods and services. A
copyright protects an original artistic or literary work. A patent protects an invention.
The Trade Marks Registry was established in India in 1940 and presently it
administers the Trade Marks Act, 1999 and the rules made thereunder.
As per THE FOURTH SCHEDULE TO TRADE MARKS RULES, 2002:
Classification of goods and services:
Class 20: horn, bone, ivory, whalebone, shell.
Class 29: Meat, fish, poultry, meat extracts, preserved, eggs.
Class 33: Alcoholic beverages (except beers).
Class 34: Tobacco, smokers articles.
Whereas, KVIC is not involved, either to manufacture or to trade, even never been in
stock, KVIC confirmed in writing to WCCB:
1. Ivory trading is prohibited by law, under section 49 of the Wildlife Protection Act,
1972, besides it, KVIC is not exempted but granted Trade Mark.
2. Meat is under the Negative list of KVIC.
3. Alcohol is also prohibited under Gandhian values, hence covered under Negative
list of KVIC.
4. Tobacco is injurious to human health, against Gandhian values and principle of
sarvodaya.
But, how and why, KVIC obtained TRADE MARK to tender false and fabricated
affidavits, being Community Policing as Scouting for Gandhian Ideology and
philosophy being, a Man of many achievements and distinctions: Voice for voiceless:
Fighter by spirit: Jat by Birth: Cobbler by Profession: Activist by Mission:
Humanitarian by Choice: Gandhian by vision and action as habitual Khadi worrier,
as freedoms of speech as legal human rights, I have intimated to the Enforcement
Agencies.
Hence, keeping in view, following points may be clarified, supplied, action on
DOCOM/E/2021/00723:
1. Copy of the Advisory No. 4 of 2020, issued by the Wildlife Crime Control Bureau to
the Trade Mark authority, related to IVORY.
2. Please clarify the definition of TRADE MARK, KVIC can get trade mark, except
ban articles, covered under law as ivory.
3. Meat, Tobacco and Alcohol, against the ethics of Gandhian ideology and
philosophy, neither traded or in stock.

The Trade Marks Registry was established in India in 1940 and presently it administers
the Trade Marks Act, 1999 and the rules made thereunder. It acts as a resource and
information Centre and is a facilitator in matters relating to trademarks in the country.
The objective of the Trade Marks Act, 1999 is to register trademarks applied for in the
country and to provide for better protection of trademark for goods and services and
also to prevent fraudulent use of the mark.
The main function of the Registry is to register trademarks which qualify for
registration as per provisions of the Trade Marks Act and Rules, and to maintain the
Register of trademarks.
After accession to the Madrid Protocol, a treaty under the Madrid System for
international registration of trademarks, the Trade Marks Registry also functions as an
office of origin in respect of applications made by Indian entrepreneurs for
international registration of their trademarks and as an office of the designated
Contracting party in respect of international registrations in which India has been
designated for protection of the relevant trademarks.
Community Policing as Scouting for Gandhian Ideology and philosophy being, a Man of
many achievements and distinctions: Voice for voiceless: Fighter by spirit: Jat by Birth:
Cobbler by Profession: Activist by Mission: Humanitarian by Choice: Gandhian by
vision and action as habitual Khadi worrier, I strongly objects on the KVIC wrong
stands on the Negative list of Gandhian values and principles because KVIC tendered
its application with affidavit, to get TRADE MARK: THE FOURTH SCHEDULE TO
TRADE MARKS RULES, 2002: Classification of goods and services - Name of the
classes: Class 20: Furniture, mirrors, picture frames, goods (not included in other
classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber,
mother of pearl, meerschaum and substitutes for all these materials, or of plastics. Class
29: Meat, fish, poultry and game, meat extracts, preserved, dried and cooked fruits and
vegetables, jellies, jams, fruit sauces, eggs, milk and milk products, edible oils and fats.
Class 33: Alcoholic beverages (except beers). Class 34: Tobacco, smokers articles,
matches.
Whereas:
1. Ivory trading is prohibited by law, KVIC is not exempted.
2. Meat is under the Negative list of KVIC.
3. Alcohol is also prohibited under Gandhian values, hence covered under Negative list
of KVIC.
4. Tobacco is injurious to human health, against Gandhian values and principle of
sarvodaya.
But KVIC obtained TRADE MARK to tender false and fabricated affidavits, Delhi
Police moved against me, being freedoms of speech as legal human rights, even Delhi
Police even failed to examine my complain along with all the attachments, tendered with
the complaints.
Hence, keeping in view, following points may be clarified:
1. Copy of the Advisory No. 4 of 2020, issued by the Wildlife Crime Control Bureau to
the Trade Mark authority, related to IVORY.
2. Please clarify the definition of TRADE MARK as I am not trading Ivory, Meat,
Tobacco and Alcohol, as all these items covered under above said class, then I am
eligible to get - obtained TRADE MARK, tendering false and fabricated affidavits that I
am involved in above said business.
3. Please clarify that I can obtained TRADE MARK for such items, in which I am
involved.
4. Please clarify that I cannot obtained TRADE MARK for such items, in which I am
not involved.
Office of Controller General of Patents, Designs & Trade Marks may apply on the
above said points.
