COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This COMPROMISE AGREEMENT (hereinafter, the “Agreement”),


entered into this ____ day of _____________ 2021 by and between:

ALEXANDER C. RETODO, of legal age, Filipino, with


address at 1031 North Residences, EDSA Munoz, Quezon City
(hereinafter “FIRST PARTY”)

-and-

IMELDA H. DOMINGO, of legal age, Filipino, single, and


with residence address at 65-C Engineering Street, GSIS Village,
Project 8, Quezon City, (hereinafter “SECOND PARTY”)

WITNESSETH:

WHEREAS, the FIRST PARTY initiated the filing of a criminal complaint


against the SECOND PARTY presently pending before the Metropolitan Trial
Court, Branch 140, of Quezon City, entitled People of the Philippines vs. Imelda H.
Domingo docketed as Criminal Case No. M-ZQN-21-00826-32-CR For: Violation of
Batas Pambansa Bilang 22 (7 Counts).

WHEREAS, to buy peace, it is the mutual desire of both PARTIES to


amicably settle their differences, without resorting to further litigation, and to
that end are willing to make mutual concessions therewith.

NOW, THEREFORE, in consideration of the above premises and the


agreements hereinafter set forth, the Parties hereto agree as follows:

1. As settlement for Criminal Case No. M-ZQN-21-00826-32-CR,


the SECOND PARTY commits to pay the FIRST PARTY the total amount
of SEVEN HUNDRED SEVENTY THOUSAND PESOS (P770,000.00)
following the below payment schedule:

a. 15 April 2021 - P5,000.00


b. 30 April 2021 - P5,000.00
c. 15 May 2021 - P5,000.00
d. 31 May 2021 - P5,000.00
e. 15 June 2021 - P10,000.00
f. 30 June 2021 - P10,000.00
g. 15 July 2021 - P10,000.00
h. 31 July 2021 - P10,000.00

i. 15 August 2021 -P10,000.00


j. 31 August 2021 -P10,000.00
k. 15 September 2021 – P15,000.00
l. 30 September 2021 - P15,000.00
m. 15 October 2021 - P15,000.00
n. 31 October 2021 - P15,000.00
o. 15 November 2021 - P15,000.00
p. 30 November 2021 - P15,000.00
q. 15 December 2021 - P50,000.00
r. 31 December 2021 – P50,000.00
s. 15 January 2022 – P50,000.00
t. 31 January 2022 - P50,000.00

2. The PARTIES hereafter agree to move for the PROVISIONAL


DISMISSAL of the abovementioned case pending compliance of this
Agreement.

3. Any default in the monthly installment payments by the


SECOND PARTY shall make the entire obligation due and demandable,
shall entitle the FIRST PARTY to move for the execution of the judgement
on the civil aspect of the case, and the revival of the criminal aspect
thereof;

4. The FIRST PARTY shall issue and sign a Release, Waiver and
Quitclaim with Undertaking and Desistance after complete and full
payment is made by the SECOND PARTY based on the schedule of
payments provided in this Agreement.

5. The FIRST PARTY and SECOND PARTY shall faithfully


comply with their respective obligations in this Compromise Agreement
and in the Release, Waiver, and Quitclaim with Undertaking and
Desistance which will be executed and signed after complete and full

payment is made by the SECOND PARTY based on the schedule of
payments provided in this Agreement.

6. The PARTIES shall waive and hereby waive any and all
causes of action that may have arisen or will arise against each other in
relation with, incident to, or in connection with the abovementioned cases.
In this connection, the parties by these presents, do hereby fully and
comprehensively release, forgive, quitclaim and discharge each other from
any claims, demands, obligations, liabilities, indebtedness, causes of action
and expenses of whatever kind, nature, description or character, whether
known or unknown, real or contingent, arising out of, incident or in
connection with the abovementioned cases;

7. The PARTIES understand that this is a general release of any


and all claims against each other and may be pleaded for the dismissal of
any pending case and as a bar to future suits which they may bring in any
court, office or agency of any jurisdiction, as a result of or in connection
with the abovementioned cases;

8. The PARTIES warrant that this Compromise Agreement was


read, explained, and understood by them, and their conformity to this
Compromise Agreement was voluntarily agreed upon without the
employment of any force or intimidation. The terms of this Compromise
Agreement are not contrary to law, morals, public order, good customs,
and public policy.
