The promise to make bonus payment is enforceable according to Stilk v Myrick (1809) 2 Camp 317
because the promiser get practical benefit from the offer. Secondly, the promise was made without any
duress. It was Roffey Bros own idea to offer extra payment, so there was no duress. Appellant gained
practical benefit by avoiding the penalty clause. Therefore, the promise for extra pay was enforceable by
law.
