ORDER DIRECTING PLAINTIFFS' COUNSEL TO FILE A LIST OF RELATED CASES


WITHIN THE THIRTEENTH JUDICIAL CIRCUIT
THIS CAUSE having come on to be considered by the Court, sua sponte, based upon the Motion to
Consolidate and Memorandum of Law served in Case No.: 20-CA-4146. Based upon the assertions
within this Motion to Consolidate, the Court examined 139 cases filed by the law firm of Marin,
Eljaiek, Lopez & Martinez, P.L. and Attorneys, David Garcia and Joe DePrado. This research
disclosed the fact that this firm and specifically these attorneys filed multiple lawsuits in various
divisions of both the Circuit and County Courts of this Thirteenth Judicial Circuit. These cases involve
allegations of both hurricane damage and water intrusion claims. The Court having examined each
and every one of these 139 cases and related court files, finds as follows:
1. Almost all of these cases are filed in separate divisions and yet many of these cases are
temporally related in terms of the timing of the alleged damages. Some cases are filed in the name
of the male property owner and some cases are filed in the name of the female property owner.
2. Some cases are filed in the name of an Assignee for damages related to underlying claims
alleged in other cases filed in separate divisions.
3. Administrative Order S-2019-047, Para. 6, addresses "Related Cases" and requires Plaintiffs'
Counsel to "notify the court of any related cases at the beginning of the first hearing on any matter
set in the case. A case is "related" if it is a pending civil case filed in the Thirteenth Judicial Circuit
Court of the Hillsborough County Court involving the same parties and same legal issues.
4. Clearly, many of the researched cases are related under the definition provided within the
applicable Administrative Order. This Court hereby extends and expands the definition of "Related
Case" to include a case in which the property owner has transferred or assigned a benefit under
his/her contract of insurance to a contractor who then brings a separate cause of action.
Based upon the foregoing and being otherwise duly advised in the premises, it is:
ORDERED AND ADJUDGED that the Managing Partner of the Law Firm of Marin, Eljaiek, Lopez &
Martinez, P.L. ("Marin Law Firm") shall within thirty (30) days of the date of this Order, prepare and
file a list of all cases within the Thirteenth Judicial Circuit where the Marin, Eljaiek, Lopez & Martinez,
P.L. law firm is counsel of record and which also have a related case or cases filed in this Circuit.
This list shall be filed in every Marin Law Firm case within this Circuit and served upon every
Defendant. The list shall also be sent via U.S. Mail directly to the Administrative Judge of the
Thirteenth Judicial Circuit General Civil Division, Judge Rex Martin Barbas.
