FUND FOR MUNICIPAL LAND FILL PROJECT Dear Hon. ABC President Andaya, In behalf of our clients, Froilan T. Gruezo, Henry A. Gruezo (Mr. Gruezo),Victorio Ronabio and Narciso Rubiales, we would like to refer to the document/paper regarding the reported authorization given by the Barangay Chairman of the forty (40) Barangays of Majayjay, Laguna (Majayjay) to use for Municipal Land Fill Project the fund (Brgy. Fund for short) made available to the forty (40) Barangays from the Municipal Development Fund (MDF) coming from the Internal Revenue Allocation (IRA) of Majayjay. In your personal meeting with our client, Mr, Gruezo, you have confirmed and admitted that the Barangay Chairman of the forty (40) Barangays of Majayjay have given alleged authorization to use the Brgy. Fund for Municipal Land Fill Project. You have even confirmed and admitted to Mr. Gruezo that the words used in the document/paper for the said authorization is “kusang loob na ipinahihiram ng mga Barangay: ang share sa MDF.” You have already made a promise and commitment to furnish Mr. Gruezo with copy of the said document/paper but despiterepeated follow-up, you failed and refused to make good your said promise and commitment. Our said clients further discovered upon investigation that the Resolution from the Sangguniang Barangay authorizing the use of Brgy. Fund for Municipal Land Fill Project which is a clear violation of the Local Government Code. It bears to remind you that the disbursement by the Barangay Chairman of the Brgy. Fund without appropriate Ordinance/Resolution from the Sangguniang Barangay is a plain and simple technical malversation and violation of Sec. 3(e) of Republic Act No. 3019, as amended, otherwise known as Anti-Graft and Corrupt Practices Act. ‘As the ABC President of Majayjay, you have admitted to Mr. Gruezo that you were the one who led and convinced the other Barangay Chairmans to execute and sign the document/paper for the said authorization using the words “kusang loob na ipinahihiram ng mga Barangay ang share sa MDF.” We wish that you will now lead by example by speatheading the withdrawal/cancellation of such authorization to use the Brgy. Fund of the forty (40) Barangays of Majayjay for use in Municipal Land Fill Project. In this difficult time of COVID-19 Pandemic, we submit that such Brgy. Fund will be better use for the upliftment of the lives of the people of Barangay who are greatly sufferings due to COVID-19 Pandemic. Otherwise, our clients will have no other legal option but to file two (2) criminal actions against the erring Barangay Chairmans before the Office of Ombudsman, to wit (i) criminal action for technical malversation and (ii) criminal action for violation of Sec. 3(e) Anti-Graft and Corrupt Practices Act. Of course, our clients will also file a separate administrative complaint for gross dishonesty, gross negligence and conduct prejudicial to the office. If you love your flocks, you will lead them to the path of righteousness and not into the dark abyss. Accordingly, formal demand is hereby set upon you to furnish our clients with copy of the said document/paper authorizing the use of the Brgy. Fund for Municipal Land Fill Project within ten (10) days from receipt hereof. We would like to remind you that your failure to complywith the Anti Red Tape Act, as amended. is punishable under Sections 21 and 22 thereof which read as follows: "Sec. 21. Violations and Persons Liable. — Any person who performs or cause the performance of the following acts shall be liable: XXX XXX XXX "(e) Failure to render government services within the prescribed processing time on any application or request without due cause; XXX XXX XXX "Sec. 22. Penalties and Liabilities. - Any violations of the preceding actions will warrant the following penalties and liabilities "(a) First Offense: Administrative liability with six (6) months suspension: Provided, however, That in the case of fixing and/or collusion with fixers under Section 21(h), the penalty and liability under Section 22(b) of this Act shall apply. "(b) Second Offense: Administrative liability and criminal liability of dismissal from the service, perpetual disqualification from holding public office and forfeiture of retirement benefits and imprisonment of one (1) year to six (6) years with a fine of not less than Five hundred thousand pesos (P500,000.00), but not more than Two million pesos (P2,000,000.00). "Criminal liability shall also be incurred through the commission of bribery, extortion, or when the violation was done deliberately and maliciously to solicit favor in cash or in kind. In such cases, the pertinent provisions of the Revised Penal Code and other special laws shall apply."Failing in this demand, we shall and will file against you the appropriate criminal and administrative actions for open and gross violation of the Anti-Red Tape Act, as amended by Republic Act No. 11032, Please do not force us to take such drastic legal actions against you.
