ACTIVITY ON THE LEGISLATIVE DEPARTMENT

Instruction: Read the facts of each case and answer the questions that follow concisely.

1. Kristine was born in the Philippines of a Filipino mother and an American father. Is she
qualified to run for Congress? Explain your answer.

Answer:
Kristine is qualified to run for the congress because she is a natural-born citizen of the
Philippines which conforms the requirement stated in Article VI Sec. 3 and Sec 6. It is
said that Kristine mother is a Filipino which conforms to Article IV Sec. 1.2 and she also
acquires her citizenship through Jus soli, the acquisition of citizenship on the basis of the
place of birth.

2. Michael was born in the United States of a Filipino mother and an American father. Is he
qualified to run as a Congressman? Explain your answer.

Answer:
Yes, Michael is qualified to run as a Congressman in the Philippines because he is a
natural–born Filipino citizen. He acquired his citizenship through Jus sanguinis which is
the acquisition of citizenship on the basis of blood relationship because his mother is a
Filipino. Michael conforms to one of the requirements for running as a Congressman.

3. Lina’s parents were from China but in the year 2000, when she was 5 years old, her parents
migrated to the Philippines and adopted Filipino citizenship. Is she qualified to run as a
Senatorial candidate? Explain your answer.

Answer:
No, Lina is not qualified to run for senatorial candidate because both of her parents were
foreigner, which means she is not a natural-born Filipino. Since Lina is not a natural-born
citizen she does not conform to one of the requirements in running for a senator.

4. Pedro was born in the Philippines of Filipino parents. They migrated in the US and after
several years, he became an American citizen. Now, Pedro decided to become a Filipino citizen
again. Will he be a qualified candidate for Senate? Explain your answer.

Answer:
Yes, Pedro can be qualified as a candidate for Senate after he re-acquired his prior
status as a natural-born Filipino citizen. Pedro can run for public office provided that he
meet the qualifications as required by the Constitution and existing laws and make
personal renunciation of any and all foreign citizenship. This means that Pedro needs to
give up his American citizenship.
