On April 6, 2021 at 2047 hours Kurt A. Frankhauser who is a member of the Bucyrus, Ohio City Council arrived at
the Sheriff's Office and spoke to the dispatcher and told her that he would like to speak to a Deputy so he can turn
in some keys. I was at the Sheriff's Office and outside doing a special detail and I met with Kurt and briefly spoke
with him. Kurt told me that he would like to relinquish two keys to the Bucyrus City Council Building which is located
at 500 South Sandusky Avenue in the City of Bucyrus, Ohio. I asked Kurt why he would not relinquish the keys
himself or give them to a Bucyrus City Police Officer and he told me that he would feel more comfortable giving
them to a Deputy. Kurt then advised me that he planned on contacting Sheriff Scott M. Kent the following day and
request some type of investigation. Kurt did not mention what or whom he wanted investigated, the circumstances
or any other information. I then led Kurt back into the administration area because he requested some type of
property receipt for the keys. Kurt relinquished two metal keys to me and advised me that both keys were to the
Bucyrus City Council and that both were his and the originals. We signed a property receipt for both keys which
were then placed in a evidence bag and sealed which was then secured in my office. I then contacted Sheriff Kent
and informed him about the matter and advised Sheriff Kent that both keys would be secured in my office.

On April 6th, 2021 at 2109 hrs, I received a call from Lt. John Schoenfelt. He advised me that
he was outside taking care of a detail I had assigned to him and was called inside to speak To
Kurt Fankhauser, who was in the lobby. Fankhauser is the Council President for Bucyrus City
Council. Schoenfelt advised that Fankhauser was there to turn over the keys to the Bucyrus City
Clerk's Office and requested an investigation. Schoenfelt advised that Kurt did not want to turn
the keys over to the Police Department and felt more comfortable turning them over to this
office. Schoenfelt advised that Fankhauser did not say what type of investigation he was
requesting and that he would come back to the office the next day to speak to me. Schoenfelt
advised that the keys were secured in an evidence bag for safekeeping and locked in his office.

I would later learn through the media that on April 6th, 2021 at the Regular City Council
Meeting, which started at 1900 hrs, that Fankhauser advised the Bucyrus City Council that he
was requesting the Sheriff's Office to investigate illegal wire tapping at the City Clerk's Office and
was doing so because the Bucyrus Police Department was under the control the City
Administration.

On April 7th, 2021, I came to work and obtained the keys from Lt. Schoenfelt's Office. I also
reviewed Lt. Schoenfelt's report that indicated that Fankhauser would be contacting me on April
7th, 2021. At 0837 hrs, I received an email from Fankhauser that read:

"Dear Sheriff Kent and Prosecutor Crall,

I am being told that Rob Ratliff is running some sort of investigation with special prosecutors regarding
myself and the council clerk’s office. Due to the seriousness of the allegations I am requesting an outside
investigation separate from Rob Ratliff’s and the Bucyrus Police Dept’s investigation to be done by the
County. I have turned over all keys in existence (to my knowledge) to the Council Clerk’s office as of last
night to Deputy Schoenfelt at the Crawford County Sheriff’s office so that a chain of custody of the office
keys has taken place. Right now the office is closed and I and the Council Clerk have no access to the
office pending completion of the investigation."

attachment Fankhauser email 4-7-2021). I did not receive any calls from Fankhauser nor did he come to
the office.

On April 8th, 2021, I was not in the office due to a meeting in Columbus. I notified Chief Deputy Chad
Filliater that Fankhauser may come on station to make a formal complaint. I asked Filliater to take
Fankhauser's complaint and I would speak to him when I returned on April 9th, 2021. At the end of
Filliater's shift, he informed me that Fankhauser never came to the office.

On April 9th, 2021, I came to the office at 0810 hrs. Chief Deputy Filliater advised me that Captain
Kevin Wert from the Bucyrus Police Department had contacted him and wanted the keys back to the
City Council Clerk's Office. I advised Filliater that we were not releasing the keys as of yet and that I
would be in contact with the City Law Director.

I contacted City Law Director Rob Ratliff and advised him that I was not going to release the keys to
the Police Department at this time and suggested that I release them back to Fankhauser, since they
were his keys and he is the one who turned them over to this office. Ratliff informed me that on April
8th, 2021 the Bucyrus City Council Public Lands and Building Committee voted to re-open the City
Council Clerk's Office and that control of that office was removed from Fankhauser and turned over to
the Public Lands and Building Committee.

Lt. Craig Moser and myself went to Bucyrus City Hall. Law Director Ratliff was not in his office. I
contacted him and requested documentation regarding control of the Clerk's Office. He advised that he
was just a couple of minutes away and that he would meet me there. Ratliff and Council Member Kevin
Meyers arrived at City Hall. I asked if I could search the City Clerk's office to look for wire tapping
devices. Both advised that it was ok for me to do so. Ratliff also provided me a letter indicating that
Public Lands and Building Committee voted to re-open the Clerk's Office and requested that keys to the
building be turned over to Councilman Kevin Meyers. (See Ratliff letter 4-9-21)

I requested consent to search the City Council Clerk's Office and was granted permission to search by
Safety Service Director Jeff Wagner (See Consent to search 4-9-21).

I unlocked the City Clerk's office and then the keys were turned over to Councilman Meyers at 0929
hrs. (See Property receipt 4-9-21)

When I entered the clerk's office, a motion alarm (Tattletale device) went off. I located a key fob
sitting on the desk next to it. I deactivated the alarm and put the key fob back down. Meyers unplugged
the tattletale device and sat it in the hallway. A couple of minutes afterwards, Council President
Fankhauser arrived at city hall and started recording or photographing Lt. Moser and myself searching
the Clerk's office, on his cell phone.

I photographed the office prior to searching it. Some of the file cabinets were locked and I did not

locate keys to the file cabinets. Police Chief Neil Assenheimer came to the office and provided Lt. Moser
with a RFI locator device. Moser scanned the office with the device and we both did a physical search of
the office. No recording or bugging devices were located.

I inquired about the security camera located on a ceiling tile. Chief Assenheimer advised me that this
camera did record video but did not record audio. He did report that Capt. Joe Greathouse could turn
the audio on to the cameras in city hall, but did not have the ability to record. He could only listen to
live audio, if needed. I asked who else had access to the security cameras. Assenheimer advised that the
Safety Service Director Jeff Wagner has access to the security cameras as well.

Fankhauser requested that the security camera and computers in city hall all be sent in to BCI&I to
see if the camera recorded audio. He advised that he found that this camera was able to record audio. I
did not find it necessary to remove the camera or computers, which would compromise security to the
building, as it had already been determined that live audio could be heard over the camera.

I photographed the security camera and then Councilman Meyers removed the calendar that was
blocking the view of the camera. When we were finished searching the office, I again photographed it,
to show the condition of the office when we left. The lights were shut off and the door was locked. I
photographed the tattletale device as well.

Lt. Moser and myself then met with Safety Service Director Jeff Wagner. He showed us that he was
able to access the security cameras from his computer. Wagner advised Lt. Moser and myself that he
did not have the capability to listen to any audio. Wagner pulled up the Clerk's Office camera and
attempted to turn on the audio. When he did so the following message showed up on his screen: Failed
to activate microphone. Several attempts were made to monitor audio and each time he received the
message. I asked Wagner when the cameras were installed in the building. He estimated around 2013. I
asked if he could try to locate documentation for that. He advised that he would locate it and send to
me at a later time.

Lt. Moser and myself then met with Chief Neil Assenheimer and Captain Joe Greathouse at the
Bucyrus Police Department. Greathouse has access to the security cameras in the building from his
computer. He is able to go back and view or save recorded video, but not audio. Greathouse advised
that he does have the capability to turn audio on to the cameras in the building, which allows him to
listen to live audio, but not record it. There is a single camera in city hall that actively records audio.
That is located in the lobby of the Police Department. No other cameras are set up to do this.
Greathouse advised that Dan Evans from King Office Services is the vendor they use for the security
system.

Lt. Moser and myself left City Hall and returned to the office. At 1317 hrs, I contacted King Office
Services and spoke to Dan Evans. He advised that about 90% of the cameras at City Hall have the ability
to listen to audio, depending on the permissions that were given when the system was set up. The

security server is located at the Police Department. He advised that Greathouse and Wagner both have
Administrator profiles, however the Safety Service Director can not access audio because his computer
is not set up with two-way audio. He advised that this is why the error message popped up when we
tried to access audio from Wagner's computer. Evans advised that permissions could only be changed
from the server and advised that he would have to go to the Police Department or remote into the
server to make those changes. Evans advised that there have been no request for changes to the
system, as to who can or cannot listen to audio.

At 1350 hrs, I received a call from Randy Bigley at Crawford County Now. Bigley advised that Kurt
Fankhauser had contacted reporter Kimberly Gasarus and informed her of the search of the Council
Clerk's Office and wanted to know if he could get a copy of my report. I advised him that the
investigation was still being conducted and not subject to public record at this time. I also received a call
from Zach Tuggle from the Bucyrus Telegraph Forum. He requested to know if I was going to put out a
news release. I advised him that at this time, I did not plan on issuing a news release and advised him
that due to the ongoing investigation, the report was not subject to public records.

At 1405 hrs, I contacted Tattletale, in Westerville Ohio. I gave the customer support person I spoke to
the serial number from the Tattletale unit found in the Clerk's Office. I was advised that it was
registered to Wavelinc and it was suggested that I contact the owner Kurt Fankhauser about the
location of the unit. I informed customer support that I was not calling for ownership of the unit but did
have questions about the unit. I was advised that the unit is a motion detector only, that would send an
alert to a cell phone when activated. I asked if the unit was capable of listening to audio or seeing video.
I was advised that this unit does not have any audio or video capabilities.

I contacted Council Clerk Todd Hill and asked him for a copy of the Public Lands and Buildings
meeting minutes from April 8th. I also requested to know when the security were originally put in place.
Hill advised that the cameras were put in place in 1994. I requested a copy of that resolution. (See

On 04-12-2021 at approx. 1030 hrs, Safety Service Director Jeff Wagner contact me and advised that
the vendor report shows that the security camera upgrades happened in 2015 and not in 2013. (See

On 04-13-2021 at 0955 hrs, I received an email from Fankhauser advising that Ron Bores was a
potential witness to speak to as he did all the wiring for the cameras at City hall and had knowledge of
the Administration's capabilities to listen to audio through the microphones on the cameras. (See

On 04-13-2021 at 1400 hrs, I spoke with Ron Bores, former Bucyrus City Utility Supervisor. I asked
him if he know about the accusations at City Hall. He advised that he did and advised that he thought
that is why was calling him. Bores advised that he installed all the wiring on this project. He advised that

he was told at first that there was no audio with these cameras. He advised that after speaking with Dan
Evans, he learned that the cameras also had microphones on them. He advised that he suspected that
the City Administration listened to them. He advised that they had union meetings and sometimes the
City Administration would come into the room and repeat almost exactly what the union had talked
about. Bores advised that the cameras work on an IP system and that the server was in a closet at the
Police Department. Bores questioned whether or not someone with an iPhone could access the
cameras and microphones since it was IP based. I asked if he knew who all had access to the security
system. Bores advised that he thought the Safety Service Director, Mayor, Mayor's Secretary, Police
Chief and dispatch all had access to the system. I asked if he knew how to turn on the microphones. He
wasn't sure, but thought you clicked on a microphone on the screen to activate the microphones. Bores
did not know who had access to the microphones and who didn't.

On 04-15-2021 at approx. 0815 hrs, I stopped down to Bucyrus City Hall. Chief Assenheimer and
myself walked around the public entrance and looked for any signage indicating that the building was
under surveillance. I did not locate any. I then went into the lobby of city and looking for the same
signage. I did not see any signage indicating that the building was under surveillance.

On 04-15-2021 at 1423 hrs, I spoke with Dan Evans again with some follow-up questions. I asked him
if he could tell me how many user accounts are set up on the system. Evan advised that there is an
Admin user profile, which the Police Department uses, a J. Wagner profile which is set up only for video,
and a KOSI profile, which is the profile that Evans uses when he needs to remote into the system. I then
asked if it was possible to access the security system through a cell phone, Evan advised that it was
possible and that he had set up two cells phones for this. One was Capt. Greathouse's cell phone and
the other was Chief Koepke, who is now retired and that profile was no longer in use, since Koepke's
retirement. While Evans was in the system looking up user profiles, he did check the Clerk's Office
camera and did advised that the audio was shut off. To clarify, this meant that audio could not be
recorded on that camera, however the Admin user profile would have the availability to listen to live
audio, if the Admin. user decided to turn it on. I also asked about a red light that turned on while I was
in the Clerk's Office on April 9th. Evans advised that the red would indicate that motion was detected
on that camera.

In a letter, drafted February 13th, 2015 by City Law Director Robert Ratliff addressed this issue with
Ohio Council 8, AFSCME, AFL-CIO. They were put on notice that the City was installing new security
cameras to supplement or replace security cameras already in place. It was addressed that no
concealed cameras would be installed and would be highly visible throughout the building. (See City

On April 9, 2021 Sheriff Kent requested I go with him to City Hall in Bucyrus to return some keys that belong
to the City Council Clerks Office.

Once we arrived at City Hall we were met by Law Director Ratliff, Council member Meyers and Safety service
director Jeff Wagner. The Sheriff turned over the keys to the Clerks Office to Meyers after permission to search the
Office was granted by Mr. Wagner. I had a permission to search form signed by Mr. Wagner.

The Sheriff and I entered the clerks Office and a alarm went off. There was a remote laying by the alarm that
was sitting on the desk. The Sheriff used the remote to shut the audible alarm off. The Sheriff began taking photo's
of the office. I requested that Mr. Meyers come in the office with us. After the Sheriff was done taking photo's we
began searching for device that could be used to listen to conversations in that office. While we were searching the
Office Mr. Meyers asked if he could take the alarm out of the office and place it outside the door. The Sheriff
advised Meyers that he didn't have any problems with him removing the alarm. A short time had pasted and Council
president Fankhauser arrived and I observed him taking pictures/video of the Sheriff and I searching the Office.
Chief Assemheimer arrived and asked if I wanted to use a RFI detector and I advised him sure. I ran the RFI detector
around the inside of the clerks Office but did not receive any RFI signal.

I searched the north side of the Clerks Office and looked inside any cabinets that would open and didn't find any
listening devices. After we were finished searching the Sheriff took photo's of the Office again prior to us leaving.

We then went down into Mr. Wagner's Office and spoke with him. We asked what he could bring up on his
computer as far as Cameras goes. Mr. Wagner took us to the cameras on his computer. We I asked him to go into
the setting where he could possible listen to the cameras his computer showed a error that indicated to me that he
was not able to listen to cameras. The Sheriff took photos of the error that was shown on Mr. Wagner's computer. It
appeared to me that Mr. Wagner's set up on his computer would only let him watch the cameras not listen to them.

We then went into the Police Department and went into Capt. Greathouse's Office. While in this Office we
reviewed the cameras. Capt Greathouse is the only one that has access to listen to the cameras but only live and the
audio can not be recorded. We then departed City Hall.
