Enjoining parents/guardians to abide by identified applicable norms


and behavioral standards as they play an important role in
safeguarding their children’s access with social media platforms and in
co-facilitating their children’s distance learning and coordination with
teachers.

3. The standards provided herein are based on various rules and issuances,
such as the Child and Youth Welfare Code, as amended, DepEd Child
Protection Policy and the Code of Conduct for Professional Teachers.

4. Private schools are likewise encouraged to adopt these standards.

5. For guidance and compliance of all concerned.


Attachment to Regional Memorandum No. ________s. 2020.

1. INTRODUCTION AND RATIONALE:

The Department of Education issued DepEd Order No. 12, s. 2020 entitled
“Adoption of the Basic Education Learning Continuity Plan for School Year
2020-2021 in the Light of the COVID-19 Public Health Emergency”, which
emphasized provisions of learning opportunities for learners through
blended distance learning modalities.

Likewise, in support to strategies in implementing blended learning


delivery modalities contained under DepEd issuances, which calls on
schools to strengthen the implementation of the DepEd Child Protection
Policy, this standards shall contribute to the realization of said strategies.
With rules and processes generally governing face-to-face interaction
among learners, school personnel and stakeholders, and in view of
situations where said face-to-face interaction could not be made, there is
a need for standards for online interaction, considering that it is one of the
most viable means of communication and interaction.
Thus, in view of the plans that are geared towards blended learning and
the use of different communication platforms for interaction between
teachers, leaners, parents and other stakeholders, such as but not limited
to use of social media, to facilitate learning and other school related
activities, these safeguarding standards are formulated to provide
guidance to:
a. Safeguard learners’ rights to a safe learning environment,
against potential abuse, and to observe a code of conduct
during online interaction with co-learners and teachers;

b. Advocate the desired demeanor and actions of teachers, with


due regard to relevant rights, whenever they are dealing with or
communicating with learners and parents on-line for school
related activities/matters; and
c. Enjoin parents/guardians to abide by identified applicable
norms and behavioral standards as they play an important role
in co-facilitating their children’s distance learning and
coordination with teachers.

It is in these contexts that these standards are formulated.


The standards provided herein are based on various laws, rules and
issuances, such as the Child and Youth Welfare Code, as amended, the
Code of Conduct for Professional Teachers, DepEd Order No. 40, s. 201 or
the DepEd Child Protection Policy, DepEd Order No. 55, s. 2013 or the
Implementing Rules and Regulations of Republic Act No. 10627 (Anti-
Bullying Act), Republic Act No. 11313 or the Safe Spaces Act and DepEd
Order No. 18 s. 2015 DepEd Guidelines and Procedures on the
Management of Children-at-Risk (CAR) and Children in Conflict with the
Law (CICL). These standards are primarily intended to prevent any forms
of abuse against learners, and to facilitate a conducive online interaction
among learners, teachers, and parents.
After consultation with representatives of learners, teachers, parents,
school heads, child protection coordinators and specialists, legal officers,
Division Offices and Regional Office representatives and in coordination
with the Stairway Foundation, Inc., these Safeguarding Standards during
Online Interaction is being promulgated.

2. COVERAGE:
These standards applies to all forms of online communication platforms,
such as through the various social media platforms and other non-online
messaging technology, so far as the principles set forth in this standards
are applicable.

The same shall be applicable to all public schools in the National Capital
Region. Private schools are likewise encouraged to adopt the same.

3. DEFENITION OF TERMS:
The following terms as used herein shall mean:
A. Online Interaction: refers to communication between teachers,
learners, parents and relevant stakeholder using of any social
media platform, as well as, any instant messaging application, so
far as applicable.
B. Social Media: is a web-based platform of communication, with
many applications, that enables online interaction and facilitates
users to generate and share specific contents. There are various
classifications of social media platforms and one can be classified
under the "social networking sites" such as Facebook1.

C. Social Media Group: an online space for small group


communication and for people to share their common interests and
express their opinion. Groups allow people to come together
around a common cause, issue or activity to organize, express
objectives, and discuss issues, post photos and share related
content.2
D. Safeguarding Standards: is a specific set of desired behaviors that
are placed as a basic guide.

E. Parent/s: refers to the biological parent/s of a learner. They refer


also to guardian/s whom the biological parent have given written
authorization. They also refer to any member of the house hold who
are of sufficient maturity or of legal age and who is with the child
during on-line interaction.
F. Teachers: Shall mean all school personnel that are required to
interact with learners.

4. INTEGRATION OF THESE ONLINE CHILD SAFEGUARDING STANDARDS AND


RULES DURING LEARNERS AND PARENT’S ORIENTATION AND IN THE
LOCALIZED CHILD PROTECTION POLICY AND LEARNERS’ CODE OF
CONDUCT:

School Heads, through the Guidance Counselor/Teacher and School


Child Protection Coordinator, must ensure that all teachers in their
respective schools are furnished with a copy of these Standards and are
oriented on its contents before conducting separate or joint orientation
activities with learners, parents and other stakeholders, to be done in their
desired manner.

5. RIGHTS AND RESPONSIBILITIES OF PARENTS DURING ONLINE INTERACTION:

RIGHTS OF PARENTS:
A. With Regard to Teachers and the School Community:

a. Parents have the right to be informed of relevant aspects
concerning their children’s scholastic performance as well
as behavior during learning and any school related session.
B. As co-facilitators in the learning of their children:

a. The parents shall have the right to the company of their


children and, in relation to all other persons or institutions
dealing with the child's development, the primary right and
obligation to provide for their upbringing3.
b. Parents have the right to discipline the child as may be
necessary for the formation of his good character, and may
therefore require from him obedience to just and
reasonable rules, suggestions and admonitions4.

GIVEN THE ABOVE RIGHTS, PARENTS ARE CALLED UPON TO EXERCISE THE
FOLLOWING RESPONSIBILITIES:

A. With Teachers and School Community:


a. To participate in school activities, which particularly involve
parents.
b. To keep abreast of DepEd’s thrusts and programs as well as
basic school rules, regulations and processes.

c. To communicate and receive feedbacks from teachers, as


scheduled.

d. To respect the teacher’s view point and to consider the


latter’s recommendation.
e. To give common courtesy to the teachers, school
personnel/officials and every learner’s private spaces and
avoid unduly responses, through any means.
f. To utilize proper venue or medium of communication to
conduct dialogue with teachers on concerns relative to the
learner.

B. As co-facilitators in the learning of their children:
a. Before Online Interaction:

i. To explain to their children the value of education and


the need to continue learning despite challenges.

ii. Encouraged to set up their children’s online learning


spaces in their homes in a place where they could
easily view and supervise the activities of their children,
while the latter are using their laptops, personal
computers, mobile devices and/or tablets.
iii. Motivate their children and have their children be on
time and well-conditioned for learning, (i.e. relaxed,
inspired, having eaten their meal/snack, and has
already answered the call of nature) before any
scheduled on-line interaction.
iv. Ensure that their children are appropriately groomed
and dressed during on-line interaction.
v. Appraised of the conduct of behaviors for children
during their online sessions and shall discuss and remind
their children thereof.
vi. If parent/s cannot co-facilitate in the learning due to
personal circumstances, they shall delegate or assign
an alternate as facilitating parent. In this case, parent
shall brief or instruct the facilitating parent on
appropriate demeanor during online interaction.
b. During Online Interaction:

i. Devote a time to observe their child’s demeanor and


behavior.
ii. Support their children adjust, when necessary.

iii. Continuously provide needed assistance to their


children.

c. After Online Interaction:


i. Support and guide their children complete any school
related activities, when necessary.
ii. Reinforce their children on the conduct of behavior of
the latter and discuss and advice thereof.

C. As guardians and protectors of their children online:

a. Manage the screen time of their children. As much as


possible, ensure that there is a good balance between
academic and leisure screen time based on children’s
developmental age;

b. Setting parental control and adult content proofing set-up in


the settings of the computer, tablet or mobile device to ban
access to inappropriate materials and sites and ensure that
their children are only accessing age appropriate contents.
c. Encouraged to discuss with their children as to control of
accounts and supervision of what are being accessed and
viewed online.

d. Encouraged to discuss with their children, safeguarding the


integrity of their online accounts by safekeeping and not
sharing their passwords and any sensitive information to
anyone.
e. Encouraged to discuss with their children any online material
that makes them uncomfortable.
f. Encouraged to regularly check the online activities (i.e. history
of sites visited) and materials that were posted by their
children online.
g. Do not create social media accounts for their children who
are below the required age (i.e. for Facebook, those below
13 years old). Nonetheless, parents must give consent to the
creation of any social media account by their child who is still
a minor.

6. RIGHTS AND RESPONSIBILITIES OF TEACHERS DURING ONLINE INTERACTION:

RIGHTS OF TEACHERS:
A. WITH REGARDS TO PARENTS:
a. Teachers has the basic right to be respected,
acknowledged and treated with dignity as a person
engaged in a noble profession of molding the nation’s
future.
b. Teachers have the right to due process of law and to
confidentiality of information relative to any investigation.

B. WITH REGARDS TO LEARNERS


a. Teachers shall exercise secondary parental authority5 and
shall have the right to determine the best manner to teach
in accordance with the prescribed curriculum standards.
b. Teachers shall exercise necessary means to impose
discipline during online interaction. They shall use positive
verbal and non-verbal communication when dealing with
behavioral challenges with learners6.

GIVEN THE ABOVE RIGHTS, TEACHERS ARE CALLED UPON TO EXERCISE THE
FOLLOWING RESPONSIBILITIES:
A. BEFORE ONLINE INTERACTION:

a. Teachers can only interact with learners online when


consented by the parent/guardian.
Written consent of the parent/s, must be secured first, with
regard to the online interaction of the learner with their
teachers and to the use or processing of any video or
image taken during interaction.

The consent may be submitted personally or through email


or any messaging technology or medium to the school
head or teacher-adviser of the learner, which shall be valid
throughout the school year.
Standardized consent form is attached as Annex “A” .

b. Teachers are encouraged to use their DepEd email


accounts to create their social media accounts for online

interaction with learners. They shall use their recent profile
picture and ensure that their image therein is suitable to
the dignity of their profession.

c. Teachers shall inform the parents on the schedule of the


online classes/interaction.

d. Teachers must be appropriately groomed and wear


prescribed attire/presentable clothes.
e. Ensure that background view is neat, clean and child safe

B. DURING ONLINE INTERACTION:


a. Teachers shall call their learners by their names. Terms of
endearment or pet names are highly discouraged.
Labeling and smart shaming shall not be committed.
b. Teachers shall use age appropriate examples and humors.
They shall avoid profanity and using sexually charged jokes
or humors, and sexual innuendos, even when not directed
towards a learner.

c. Teachers shall only assign academic-related tasks to


learners.
d. Teachers shall encourage the observance of quarantine
and safety measures. They shall refrain from requiring
learners to perform activities or projects when it entails
violating the health protocols by the Department of Health
(DOH) or any government agency.
e. Teachers shall respect the private spaces of learners. They
shall not join nor organize non-school related or purely
private online group video calls or chat areas with his/ her
learners. Teachers shall keep in confidence learners’
sensitive and personal/private information or
circumstances, known to them by reason of their work.

f. Teachers shall maintain safe communications with


learners. They must not participate in one (1) on one (1)
private messaging with learners, without parental consent
and supervision, except in the following situations;
i. Receiving disclosure of any child protection
concern from the learner, provided that the
teacher asks permission from the student to have
the guidance counselor join the chat.

ii. That the online disclosure be reported to the


school head/ Child Protection
Committee/guidance counselor/guidance
teacher within 24 hours regardless of the consent
of the learner to have the disclosure reported to
the CPC/Guidance counselor.

g. Teachers shall uplift all learners and shall not privately


promise to give a special gift/favor, to a specific learner.
h. Teachers are bound by CSC rules against receiving gifts
and favors. Hence, they shall not directly or indirectly ask
or solicit for gifts, presents, treats, or favors from their
learners/ parents.
i. Teachers shall provide appropriate credit to learners. They
shall not make any threat of deduction of grades as a
form of punishment. They shall also refrain from
unnecessarily providing “special - plus grades/points”.

C. AFTER ONLINE INTERACTION:


a. Teachers must, upon request or during scheduled sessions,
update the parent/s or guardians, through any available
and agreed communication platforms, on the
performance status of the latter’s children.

b. Teachers must also respectfully inform the parents of any


behavioral issues or challenges that they may have
encountered and the recommendations to address said
issues, when necessary.

7. RIGHTS AND RESPONSIBILITIES OF LEARNERS DURING ONLINE INTERACTION:


RIGHTS OF LEARNERS:
A. Learners have the right to be respected irrespective of the
child’s or his or her parent's or legal guardian's race, color, sex,
language, religion, political or other opinion, national, ethnic or
social origin, property, disability, birth or other status7.

B. Learners have the right to freedom of expression; this right shall


include freedom to seek, receive and impart information and
ideas of all kinds8.

C. Learners have freedom of thought, conscience and religion9, of


association and to freedom of peaceful assembly10.
D. Learners has the right against subjected to arbitrary or unlawful
interference with his or her privacy, family, home or
correspondence, nor to unlawful attacks on his or her honor and
reputation11.
E. Learners has the right to access to information and material from
a diversity of national and international sources, especially those
aimed at the promotion of his or her social, spiritual and moral
well-being and physical and mental health12.

F. Learners have the right against all forms of abuse, cruelty or


exploitation13 from any sources, whether from members of the
family and members of the community, strangers, and other
leaners and from school personnel.

WITH ALL THE RIGHTS OF LEARNERS, THEY HAVE THE FOLLWONG


CONCOMITANT RESPONSIBILITIES:
A. Learners shall be on time during online sessions.

B. Leaners shall be kind to and treat all teachers with respect.


Learners shall not engage in any acts that produce any harmful
effects to school personnel through social media and other
communication platforms.

C. Learners shall respect the personal spaces of co-learners and
avoid creating fake accounts and contents.

D. They should understand and be emphatic to the situation of


others. They shall not engage in online bullying and report any
bullying incidences to his/her adviser, when they become aware
of it.
Online Bullying includes:

-Habitual posting of any message that humiliates or cause


embarrassment to a co-learner online;
-Sending, posting, or sharing negative, harmful, false, or
mean content about a co-learner
-Sharing personal or private information about someone
else causing embarrassment
E. Report any behavior of any learner that makes them feel
uncomfortable to their adviser or guidance counselor.

F. Follow the instructions and directions of teachers, as long as this


will not lead to personal harm.

G. Learners shall think first before clicking the “post” or “share”


buttons in social media. They should avoid posting inappropriate
materials/content that may lead co-learners, teachers or other
persons to feel bad.
H. Learners shall also protect one’s privacy and the privacy of others
by not sharing or posting the following information of others,
when known:
a. About an individual’s race, ethnic origin, marital status,
age, color, and religious, philosophical or political
affiliations;
b. About an individual’s health, education, genetic or
sexual life of a person, or to any proceeding for any
offense committed or alleged to have been
committed by such individual, the disposal of such
proceedings, or the sentence of any court in such
proceedings14;

Any learner who violates this provision shall be subjected to
intervention programs by the CPC/Anti-Bullying Committee (ABC)
and other administrative proceedings before the School Head,
pursuant to existing DepEd rules and regulations, when warranted.

8. GENERAL PROCEDURE BEFORE, DURING AND AFTER ONLINE INTERACTION


WITH LEARNERS AND TEACHERS:

A. BEFORE ONLINE INTERACTION:


a. Schools must first conduct orientation with parents and discuss
basic matters regarding:

i. Basics of the DepEd Learning Continuity Plan and school


activities;

ii. Mechanics, schedules, rules, procedures and other


matters relative to the online learning scheme adopted.
iii. Schedule of providing updates and feedbacks on the
performance of learners.
b. Parents and Learners shall be ready with any online interaction
and shall comply with their respective responsibilities before
online interaction as mentioned herein.
B. DURING ONLINE INTERACTION:

a. Teachers, parents and learners shall comply with their


respective responsibilities during online interaction as herein
provided.
b. Teachers must, as much as possible, always inculcate and
remind learners of their responsibilities under this standards.

C. ONLINE INTERACTION BETWEEN PARENTS AND TEACHERS:


a. Teachers must inform parents, during scheduled sessions,
regarding their child’s performance and behavior.

b. Teachers, must as much as possible immediately, bring to the


attention of the parents any behavioral challenges that the
latter’s children exhibits and any recommended action on said
behavior.
c. Teachers and Parents should always remember their respective
rights and their concomitant responsibilities as provided herein,
whenever they are interacting with each other online.
9. SAFEGUARDING STANDARDS FOR LEARNERS’ DATA AND PRIVACY:

A. Consent from parents is needed before school personnel can post


images/videos of learners on social media platforms.
B. The consent shall be secured at the start of the school year, and shall
be in writing. Consent form is attached as Annex “A”.
C. The consent shall cover all images/videos taken for the school year and
shall be used only for school documentation purposes and other
legitimate purposes.
D. Once permission has been provided, the preceding standards shall
govern:
a. The image(s)/videos must neither mislead the viewer as to the
actual situation of the subject of the pictures nor distort reality.

b. Ensure that data/information on the full name, address, age,


grade level, grade, name of parents, contact details and any
other personal circumstances are not seen or be publicly
accessible.
c. Ensure that only images of learners in appropriate dress,
environment and pose are taken.
d. Learners must not be depicted in an awkward,
compromising, discriminating, or dangerous situation.
e. Learners must not be depicted in a sexual or sexualized
manner or context that can constitute images of abuse.

f. Images taken shall not depict violence, pornography, or


crime.
E. Provision of Corrective Measure Process:

a. Any person (teacher/parent/learner) may report any issue as


to the use of any learner’s data/information contained in any
posted material with the school head/guidance counselor.
b. The school head, through the guidance counselor, shall
validate whether there has been a violation of the Data
Safeguarding Standards.
c. Once, determined, the school head shall instruct the
responsible school personnel to take down the posted
material/content immediately.
When the school personnel fails to abide by these directives, he/she
shall be subjected to disciplinary procedures.

2. SAFEGUARDING STANDARDS FOR MODERATED PRIVATE SOCIAL


MEDIA/LEARNING GROUPS :
In order to maximize communications and interactions between Teachers
and Learners, social media groups15 via social media platforms, may be
created.
Such social media groups shall be UNDER PRIVATE SETTING AND PROPERLY
MODERATED because the same will contain records of an official
interaction between and among learners and teachers, hence, such
social media groups shall be called as “MODERATED PRIVATE SOCIAL
MEDIA/LEARNING GROUPS”.
The following standards are as follows:

AGE AS A FACTOR TO CONSIDER:


A. The use of Moderated Private Social Media Groups/Learning
Groups (Group) shall be applicable to Junior and Senior High
School learners, in accordance with common social media
platform’s policy in terms of age usage (13 and above).

B. If a Junior High School learner is below 13, then he/she shall not
be part of the moderated social media group, but instead, shall
receive communication via other means identified by both the
teacher, the parents/guardians.
C. For Grades 1 to 6, teachers shall employ either messenger group
chats or Facebook groups with the parents of the learners.

CONSENT OF SCHOOL HEAD NEEDED:
D. The teacher/adviser shall inform the principal and the guidance
counselor of his/her intention of creating a class moderated
social media group for his/her class.

E. Once consent has been given, the adviser shall create the
group using her DepEd email account and set the privacy
setting to a private group.

F. The adviser, school head, or his/her representative shall be co-


administrators of said class group.
ADMINISTRATORS/MODERATORS:

G. All moderated school social media groups shall always have the
following as moderators:

a. 1 guidance counselor/teacher or grade level


chairperson or coordinator; and
b. 1 learner class representative (High School).

H. Under no circumstances shall any of the aforementioned


administrator/s and moderators be removed from the class
social media group.
I. The guidance counselor/guidance teacher/grade level
coordinator’s interaction shall be limited only to observation
tasks to ensure that potential cause of harm to anyone is
prevented and not committed within the group.

J. Guidance Counselors may immediately intervene on actionable


reports or posts seen in said group.
K. Moderators and Administrators shall be guided by the following:

a. Administrator/s or Moderator/s shall be aware of basic


social media etiquette in relation to the Code of
Conduct and Ethical Standards, when dealing with all
stakeholders during social networking;
b. Administrator/s may officially respond to queries and
other matters posted in the group, in a manner that
may be directed by the adviser or school head.
Moderator/s cannot represent the school and provide
any official statement. Nonetheless, both administrator/s
and Moderator/s can answer basic queries.

c. Administrator/s or Moderator/s shall maintain the


confidentiality of the reporter and any private messages
that may have been sent in their respective private
accounts regarding reports of child abuse/bullying and
forward the same to the guidance counselor within 24
hours;
d. Administrator/s or Moderator/s shall not be allowed to
delete any message posted in the group unless,
directed by the Head of Office or the latter’s authorized
representative. They may however immediately use
“hide” functions for posted messages which are
offensive on its face; and
e. The School Head shall forward to the Regional Legal
Unit’s email address: legalunitncr@ymail.com any
message/s relating to reports on child abuse committed
by teaching personnel. On the other hand, reports on
child abuse committed by non-teaching personnel shall
be reported to the Division Legal Unit.

L. One (1) representative of the Homeroom PTA may be invited as


member-observer of the group. As observer, the PTA
representative shall sign a confidentiality agreement16 and
he/she is not allowed to interact with any learner in the group.
He/ She may report any observation to the guidance
counselor/adviser.
M. The moderated social media group shall not hinder learner’s
access to information and class announcements and as such,
the class advisers shall find ways to relay information to learners
who would not have access to such channels/ technologies;

ENCOURAGED AND PROHIBITTED POSTS:


N. Posts in the Group shall be limited to:
a. Authentic news that may affect the class;

b. Information relative to the class/school activities; and

c. Official school announcements.
d. All other relevant matters for learning.

O. Posting/sharing of fake news, unverified information, offensive


materials, commercial advertisements and any material that
does not promote learning, shall not be allowed in the group
and administrators/moderators must hide said posts
immediately, without prejudice to removal as may be directed.

3. REPORTING PROTOCOLS FOR REFERRAL AND ACTIONS ON VIOLATION OF


THE STANDARDS AND RELATED POLICIES.

A. DepEd Order No. 40, s. 2012 reportorial and referral protocols:


Reported acts of child abuse committed by a school personnel
must be reported to the appropriate disciplinary authorities.
The victim-child shall be subject for intervention and referred to
the appropriate government agencies by the Child Protection
Committee.
B. DepEd Order No. 55, s. 2013 reportorial and referral protocols:

Reported acts of bullying committed by learners against co-


learners shall be investigated according to the administrative
procedures under the Implementing Rules and Regulations of the
Anti-Bullying Act.
The victim-child and the bully shall be subjected for intervention
and referred to the appropriate government agencies by the
Anti-Bullying/Child Protection Committee, when necessary.
C. DepEd Order No. 18, s. 2015 reportorial and referral protocols:

When a child has been identified as a Child-At-Risk (CAR) or a


Child in Conflict with the Law (CICL), the school guidance office
shall make the necessary referral to the DSWD, and appropriate
intervention programs shall be made.

4. MONITORING AND EVALUATION:


Schools Division Offices, through the joint efforts of the Division Legal Unit,
Division Child Protection Coordinator, and the School Governance and
Operations Division, must ensure compliance by School Heads as to the
need to advocate and orient learners, parents and teachers relative to
the following:
a. Their respective rights and responsibilities under this
standards;
b. The standards and limits in the creation of Moderated Private
Social Media/Learning Groups;

c. The basic protocols on the referral and reportorial actions in


case of violation of any established rules; and
The Schools Division Office, through the Division Legal Unit and the Division
Child Protection Coordinator shall continuously gather feedback in the
implementation of these standards and shall submit to the Regional
Office, through the Regional Legal Unit, a report as to recommended
matters to be developed within one (1) month from the opening of
classes for SY 2020-2021.
A monitoring tool shall be issued thereafter.

5. MISCELLANEOUS PROVISIONS:
A. The provisions of these standards may be further localized and
adopted by school in their Child Protection and Anti-Bullying
Policy with Student Code of Conduct.
B. These standards shall be effective immediately.

C. These standards shall be regularly reviewed and updated.
