SUBJECT : Investigation Report regarding of deaths of Ellah Joy Pique Abduction

DATE : March 3, 2011

I. AUTHORITY: Verbal instruction from Cebu Provincial Director regarding of deaths Ellah
Joy Pique.

II. MATTERS TO BE INVESTIGATED

1. To justify whether the couple is liable in the case

2. To determine if there was a kidnapping with homicide

3. To impose penalty if they are proven guilty

III. FACTS OF THE CASE

That on or about 4 pm in February 8, 2011 the girl Ellah Joy Pique together with
her friends walking in the street suddenly a black SUV stop beside of Ellah Joy and pick
up her. After that, the friends of Ellah told her mother that Ellah was pick-up by
unidentified person.

A day’s after there was a report that a dead body was found at Sayaw Barili
cebu. When the barili Police that it was a child they immediately coordinate to talisay
Police and they confirmed that it was the missing girl Ellah Joy Pique. Based on the
testimony of the three (3) child and the cartographic sketch of the Police they identified
the suspect that it was a Norwegian national Sven Eric Berger and his wife Karen Castro
Esdrelon because of the matching of the cartographic sketch.
IV . DISCUSSION

Base on the preliminary investigation conducted by the undersigned, it disclosed


that Ellah Joy Pique was abducted by the suspect Berger and Esdrelon identified by the
Ellah’s friends. An SUV car used by the suspect in abducting at Calajo-an School
Minglanilla, cebu. The cebu provincial police office received calls from the immigration
officer that the cartographic and was invited to Cebu Provincial Police Office for an
investigation. Witnesses are positively identified the suspect who abducted Ellah Joy
Pique but the suspect claim for alibis and preset there supporting evidence that when
abduction of the victim went to Water Front Hotel and her wife was enrolled at the
Norwegian School.

As to the manner of facts gathered and base to the evidence presented by the
couple in the court. Their documentary evidence and the footage were confirmed by the
NBI Region VII. The NBI report and the other evidence were given credence by the
prosecutor who handled the complaint.

V. I conclude that the cased of Ellah Joy Pique was still Unclose due to the weak
evidence gathered by the police to the suspect Berger and Esdrelon. Further
investigation of the case should take action and investigate the case immediately.

VI. Cebu Provincial Prosecutor Office recommended to dismissal of the kidnapping


with homicide complaint filed a Norwegian national and his Filipina girlfriend as a
evidence against them are insufficient to indict them of a crime charged.
