AN ORDINANCE PROHIBITING THE EXCESSIVE BLOWIHG OF HORNS,

MODIFIEDIOPEN MUFFLERS, AND THE INSTALLATION OF LOUDIFC}IAfER
HORNS, HORNS OF VARYING SOUNDS, STEREOS AND OTHER SIMILAR
DEVICES THAT PRODUCE EXCEPTIONALLY LOUD OR STARTLING SOU}{D ON
ALL TYPES OF VEHICLES PLYING ALONG THE ROADS OF THE MUNIGIPALITY
OF SAN IIATEO, RIZALI

WHEREAS: Section 447 oI R.A 7160 otherwise known as the Local Government code
of 1991, the sangguniang bayan, as the legislative bdy of the municipality,
shall enact ordinances, approve resolutions xxx for the general welfare of
the municipality and its inhabitants xxx and shall.

(a)(s){vi Regulate the use of streets, avenues, alleys, sidewalks, bridges

xxx establish bus and vehicle stops and terminals or regulate the use of
the same by privately-owned vehicles which serve the public >o<x;

WHEREAS: Excessive blowing of horns produce noise that could affect human
eardrums and likerrvise creates irritating sound causing distudcance not
only in school and hospital zones but also in commercial and residerdial
zones along the roads of the Municipality;

WHEREAS: lt has been observed that there are vehicles plying along the thoroughfares
of the Municipality, predominantly by public utility vehicles using power
/ horns and horns of varying sounds, modifiecl/open mufflers, loud stereos
n / and other similar devices that emit noises. !n result thereto, numetrous

particularly through social media requesting the Municipal Government to

resolve the problem regarding the excessive noise produced by the
aforementioned vehicles;

TIUHEREAS: ln consonance with the aforementioned mandate and for the promotion of
the general welfare of the people, the Municipal Government deems it
necessary and urgent to prohibit the excessive blowing of horns,
modified/open mufflers, and ban the installation of loud/power horns,
horns of varying sounds, sirens, loud stereos and other similar devices
that produce exceptionally loud or startling sound on all types of vehicles
plying along the thoroughfares of San Mateo, Rizal;

NOW THEREFORE, upon motion of Councilor Joel P. Diaz and duly seconded by
Councilor Cristeo B. Cruz, BE lT ORDAINED AS lT lS HEREBY
ORDAINED by the Sangguniang Bayan of San Mateo, Rizal, by virtue of
the powers vested in it by law, in session assembled, that:

Section {. Definition of Terms:

As used in this Ordinance, the following terms shall mean:

a) Public Utility Vehicles - refer to motor vehicles for hire such as public
utility jeepneys, buses, tricycles, taxis, utility vans, and such other
vehicles used as a public conveyance to transport passengers.

b) Excessive blowing of Hom - shall mean unnecessary blowing of horns

or the act of blowing the horn continuously, or when there is more than
a single or a short sound of the horn.

c) Homs of Varying Sounds - horns that produce impulsive sound with

different tones that varies in sound pressure level.

d) Norse - startling and disagreeable sound; unwanted sound;

e) Loud /Power Hom - horn that emits exceptionally loud, disturbing and
disagreeable sound.

0 Sfereo - a piece of electronic equipment that plays the radio, CDs, etc.,
and creates a sound that is directed through two or more speakers so
that it seems to surround the listener and to come from more than one
source.

g) Similar Devices - any device intended to produce or which actually

produces noise or startling sound when operated or handled.

tt) Sound - the sensation produced by stimulation of the organs of hearing

by vibrations transmitted through the air or other medium; The
particular auditory effect produced by a given cause.

t) Muffler- a device to reduce noise from the exhaust of an internal
combustion engane.

i) Modifred/Open Muffler- a device attached to a motor vehicle which was

changed in the form or character, and varies from its intended purpose
on which a sound booster and other sound emitting device is installed
in order to increase noise and for other purposes.

Section 2. Coverage. This Ordinance shall apply to all types of vehicles plying along
the thoroughfares of San Mateo, Rizal.

Section 3. Prohibited Acts.

b) Excessive blowing of horns of all types of vehicles plying along the

thoroughfares of San Mateo, Rizal which produce irritating sound and
causing disturbance to the people.

c) Modified/Open mufflers on all types of vehicles which increase the

noise and creates irritating sounds. Such vehicle shall be equipped at
all times while operating in the Municipality with silencers or mufflers
that are in good working condition.

Section 4. Penalties.

l-J any person who shall not comply with any provision of this Ordinance
shall be penalized by confiscation of the prohibited device and shall be
fined as follows:

a) l=t offense - A fine of Php 1,500,00 and confiscation fee of Php 200
per day to retrieve said device.

b) 2n" offense - A fine of Php 2,000.00 and confiscation fee of Php 200
per day to retrieve said device.

c) 3'd and succeeding offenses A fine of 2,500.00 and destruction or

forfeiture in favor of the Municipal Government of the confiscated
device.

Any Barangay Captain who shall not implement this Ordinance shall be held
Iiable to administrative sanctions under existing laws.

Section 5. lmplementing Rules and Regulations (lRR). The Office of the Mayor shall
issue the lmplementing Rules and Regulations for this Ordinance.

Section 6. Repealing Glause. All ordinances, rules and regulations or parts thereof

that are inconsistent or not in conformity with this ordinance are hereby
amended, repealed and modified accordingly.

Section 7. Separability Clause. lf for any reasons, any provision of this ordinance is
declared to be unconstitutional or invalid the other provisions hereof not so
affected shall continue in fullforce and effect.

Section 8. Effectivity Clause, This Ordinance shall take effect immediately upon its
approval, and after due compliance with publication requirements.
