AGREEMENT TO SEPARATE.

The parties have agreed to separate and live permanently apart. The purpose of this Marital
23
Settlement Agreement is to facilitate the entry of Judgment and to make a final and complete
24
settlement of the property rights and obligations as well as the support rights and obligations
25
arising out of the marriage.
2 PROCEEDINGS.
3 This proceeding for Dissolution of Marriage was filed in the Superior Court of the State of
5 August 3, 2005. The court acquired jurisdiction over the Respondent on August ____2005, by
7 STATUS.
8 The parties agree that irreconcilable differences have arisen such that it has resulted in the
9 irremediable breakdown in their marital relationship and that the passage of time and assistance
10 of the court or a counselor would not help repair the marriage. They further agree that they each
11 would like their marital status be terminated six (6) months after the court obtained jurisdiction
12 over the Respondent. They agree and ask the court to enter a judgment terminating their marital
13 status and returning their status to that of single individuals as of January 29, 2005.
14 SPOUSAL SUPPORT.
Payor shall pay to Recipient $400.00 per month as and for Spousal Support, payable ½ on the
15
first of the month and ½ on the fifteenth of each month commencing September 1, 2005 and
16
17 continuing until September 1, 2006, unless terminated earlier by death of Recipient, remarriage
18 or cohabitation with another person of Recipient, or death of Payor. In no event shall Payor be
19 obligated to pay Spousal Support to Recipient after September 1, 2006. This order is non-
20 modifiable as to both amount and duration. This order is absolute, unconditional and
21 irrevocable. The termination date of October 1, 2006 is absolute. As of that date, this order cuts
22
off forever the right of either on of the parties to ask for support payments and the right of the
23
other to receive support payments. No court has jurisdiction to extend or order any payments
24
(except arrears) beyond this date. This order may work great and unexpected hardship on or
25
both of the parties, but by stipulation, the parties have elected to set a fixed and specific date
4 FAMILY RESIDENCE
5 1. The parties own a mobile home and property located at 1234 Mary Street, Riverside. The
6 Petitioner shall be awarded the mobile home and property. The Respondent shall
7 cooperate in the signing of the title to the mobile home and the signing of an Interspousal
8
Transfer deed for the land, giving to the Petitioner 100% of her interest in the land and
9
mobile home.

2. Petitioner agrees that Respondent may live in the mobile home rent free for one year
11
from the date of the signing of this judgment.

DIVISION OF PROPERTY

The Petitioner shall be awarded as his sole and separate property the following items and shall
14
hold the Respondent harmless from any encumbrances thereon:

2 The Petitioner currently has a 401k through Sully Miller contracting plan. The Petitioner shall be

The Petitioner shall be responsible for the following debts:

1. Great American Finance for 2001 Dodge Truck loan in the sum of $30,000.00.

8 MUTUAL RELEASE.
9 The parties agree and intent that this agreement will settle all aspects of their rights and
10 responsibilities arising out of this marital relationship and ask that the court enter judgment based
11 on the terms of this agreement. Except as otherwise provided herein, the parties acknowledge
12
and agree that by signing this agreement they mutually release and forever discharge each other
13
from any and all actions, liabilities, claims, demands, and obligations of any kind or character,
14
both in law and in equity, that either of them ever had, now has, or may have against the other
15
upon or by reason of any matter, cause, or thing up to the date the Court enters judgment based
16
on this agreement. The parties agree to ask and request that the Court find that it is the intention
17
of the parties that this agreement become effective on the date it is executed and that after the
18
date of execution of this agreement there shall be, as between the parties, only those rights and
19
20 obligations as are specifically provided in this agreement and ask that the Court enter judgment
23 The parties agree that any property acquired by either party after the separation date shall be the
24 sole and separate property of the party acquiring it. The parties agree and ask that the Court

3 OTHER ORDERS
4 The Petitioner agrees to maintain health insurance for the Respondent Until September 1, 2006.
5 In the event that Petitioner may no longer maintain health insurance on the Petitioner through his
6 employer due to company policy, Petitioner agrees to maintain Cobra coverage for the benefit of
7 the Respondent for that one year.
