• The very concept of fundamental right is that it being a right guaranteed by the Constitution

these cannot be taken away by the law . [PLD 2010 SC 265]

Article 11
(1) Slavery is non existent and forbidden and no law shall permit or facilitate its introduction into
Pakistan in any form.

(2) All forms of forced labour and traffic in human beings are prohibited.

(3) No child below the age of 14 years shall be engaged in any factory or mine or any other
hazardous employment.

Article 9
No person shall be deprived of life or liberty save in accordance with law.

Article 10 A Right to a fair trial


For the determination of his civil rights and obligations or in any criminal charge against him a person
shall be entitled to a fair trial and due process.

Article 14
(1) The dignity of man, and, subject to law, the privacy of the home shall be inviolable.

The Pakistan Supreme Court in 2013 SCMR 1383 said that right to life includes the right to
livelihood.

Article 18 Freedom of trade, business or profession.


Subject to such qualifications, if any, as may be prescribed by law, every citizen shall have the right to
enter upon any lawful profession or occupation; and to conduct any lawful trade or business:

Article 19 Freedom of speech and expression and freedom of press (subject to certain restrictions
“public order, decency or morality”)

Article 19A. Right to information.


Every citizen shall have the right to have access to information in all matters of public importance
subject to regulation and reasonable restrictions imposed by law.

Article 23.
Every citizen shall have the right to acquire, hold and dispose of property in any part of Pakistan, subject
to the Constitution and any reasonable restrictions imposed by law in the public interest.

Article 24 Protection of Property Rights


(1) No person shall be deprived of his property save in accordance with law.
(2) No property shall be compulsorily acquired or taken possession of save for a public purpose (and
compensation shall be paid).

Article 25 Equality of Citizens


(1) All citizens are equal before law and are entitled to equal protection of law.

(2) There shall be no discrimination on the basis of sex.

(3) Nothing in this Article shall prevent the State from making any special provision for the
protection of women and children. (Affirmative action)

(4) S5 of Contract Act 1872. A proposal may be revoked at any time before the communication of
its acceptance is complete as against the proposer (offeror), but not after the proposal has been
accepted.

Contract Act 1872 S.7 “acceptance must be absolute and unqualified.”


S.8 – Performance of the conditions of a proposal, or the acceptance of any consideration is an
acceptance.
