This letter is in relation to an email which you sent to the Humberside Police website
on 27 December 2016 at 12:03 hours, relating to a complaint which you wish to
make about Chief Superintendent neaton and the Professional Standards Branch.

Your complaint is regarding complaint CO 461 15. You stated,

lA letter dated 19 November 2016 (ref: CW/DEJ) from DC Superintendent Christine


Wilson outlined a number of decisions concerning reported crimes that Humberside
police previously claimed it had no remit to investigate. That decision (no remit to
investigate) was contested in a complaint (ref: CO/461/15). dealt with by Local
Resolution and the decision not to investigate upheld by the force. This was
appealed and the review outcome (HAB/LSU/45/20383/AS) also upheld the Local
Resolution process.
There appears to be an abuse of the complaints and appeal process indicated by
the way the force routinely finds against the complainant and backs up the force's
decision, presumably so it can present performance figures that portray a
favourable image. The Independent Police Complaints Commission (IPCC) backs
up this view with figures released showing that not one appeal investigated by
Humberside Police was upheld in 2015/16 despite more than 500 complaints made
in that period with 106 outcomes appealed against. .
With the appeal decision only chal!engeable in the High Court there is no redress
the average person can get save risking their home in the casino justice system
where it can be relied on the odds being stacked against them.
Representations made on the findings of the Local Resolution process should have
satisfied the force that the decision was wrong and the appeal upheld.

Humberside police have effectively admitted this by investigating (so it claims) the
allegations which it maintained throughout the complaints process were not criminal
matters.
Manipulating performance figures this way is a complete abuse of the Police
Reform Act 2002 and Police Reform & Social Responsibility Act 2011. All the tricks
of the trade seem to be exploited by the force in the complaint procedure knowing
that the statute governing the process does not permit the IPCC to intervene and
consequently provides every incentive for the force to misconduct itself.

In 'additional notes' you go on to say that,

Gross injustice suffered as a consequence of the failure to discover the truth
Because of the failure highlighted in this complaint I have been wrongly convicted of
an offence and consequently now having a criminal record and incurred a direct
financial loss of £620. The loss is the aggregate of the criminal court's charge, costs
and victim's surcharge. I've also experience the distressing effects of being
wrongfully arrested and falsely imprisoned (twice), along with the inevitable
damaged reputation of having a criminal record and local Newspaper publish a
biased and defamatory report. Grimsby Magistrates' court has made serious errors
in respect of this matter which has led to my wrongful conviction - adding further to
the gross injustice caused in engaging the court to admit its failings. Being
subjected to the court's incompetence/ malevolence would have been
avoided were it not for Humberside polices failure. The unwillingness to accept
responsibility in this matter has led to time consuming and fruitless disputes; -
Parliamentary Ombudsman - Independent Police Complaints Commission - police
complaints/appeals - permission to appeal Magistrates court's decision to Crown
court. Add to this a substantial amount of time expended having to research court
procedures and trying to obtain evidence with the use of freedom of Information.
Factoring in the damaged reputation and hundreds of hours engaged in pursuing
this matter, I consider (if you can quantify this in monetary terms) that I have been
caused at least a £20k loss. There is also a costs/damages issue (including
potential loss of earnings) which if aggregated along with the previous years of
gross inconvenience of having to deal with the negligence related to this complaint
would amount to literally hundreds of thousands of pounds. I am clearly a victim of
the loyalty officers serving with Humberside police have for one another and paying
the price for police officers protecting their colleagues from the serious
consequences that should arise from their misconduct. The charade is being
maintained at my expense, which includes having to tolerate being wrongfully
convicted etc., and the gross injustice of being in dispute with the various negligent
public bodies as a consequence which will continue with no prospects of ever
ending.'

You have noted the correct way to challenge a decision made by the Humberside
Police Appeals Board is through judicial review and should you wish to do so you
may wish to contact a solicitor.

This matter will not be recorded as a complaint against police as this would be an
abuse of the complaints process.

If you are not happy with the decision you can appeal to the Independent Police
Complaints Commission. Enclosed is a document advising you of this process. You
have 29 days within· which to make your appeal to the IPCC. You are advised to
post your appeal in good time to ensure it reaches the IPCC before the end of the
29th day. The 29th day is 03 February 2017. Appeals received after 29 days may
not be allowed unless there are exceptional circumstances.
