EXTRA-JUDICIAL SETTLEMENT OF THE

ESTATE OF THE DECEASED BASANIO TELLO

KNOW ALL MEN BY THESE PRESENTS:

This Extra-judicial Settlement of the Estate, made and executed by and among:

HILDA C. TELLO, of legal age, widow, residing at Brgy. Dontogan, Green Valley,
Baguio City;

ELIZA TELLO-HANSEN, married to PETER HANSEN, both of legal age,


formerly Filipino citizen, now a naturalized Australian citizen, with address in the
Philippines at Brgy. Dontogan, Green Valley, Baguio City;

PHILLIS TELLO-HSIA, of legal age, widow, Filipino citizen, with address in the
Philippines at Brgy. Dontogan, Green Valley, Baguio City;

DIBRA TELLO, of legal age, single, formerly Filipino citizen, now a naturalized
Australian citizen, with address in the Philippines at Brgy. Dontogan, Green Valley, Baguio
City;

RUTH TELLO-RIO, married to REX RIO, both of legal age, formerly Filipino
citizen, now a naturalized Australian citizen, with address in the Philippines at Brgy.
Dontogan, Green Valley, Baguio City;

JOSEPH TELLO, of legal age, Filipino, single, residing at Brgy. Dontogan, Green
Valley, Baguio City;

JOIEDA HOPE TELLO-RADIE, married to SALIH RADIE, both of legal age,


Filipinos, residing at Brgy. Dontogan, Green Valley, Baguio City;

JESIMIEL BAS C. TELLO, single, of legal age, Filipino, residing at Brgy.


Dontogan, Green Valley, Baguio City;

BASANIO TELLO, JR., of legal age, Filipino, a minor child but represented herein
by her mother, HILDA C. TELLO, residing at Brgy. Dontogan, Green Valley, Baguio City.

WITNESSETH:

1. The above-named parties are the surviving spouse and the legitimate children and
sole heirs of BASANIO TELLO, who died in Baguio City on September 24, 2000. without
any will.

2. The said deceased, at the time of his death, left certain real properties situated in
Pangasinan, La Union and Benguet Province, and more particularly described as follows:

PARCEL I – T.C.T. No. 210052 (San Fabian, Pangasinan)

“A parcel of land (Plan Psu-52785), with the


improvements thereon, situated in the Bo. of Anonang, Mun. of
San Fabian. Bounded on the N., by a ditch and property of
Venancio Narvasa; on the NE., by a ditch and property of Felix
Imbat; on the E., by property of Sergio Gaita; on the S., by
properties of Gregorio Grospe and Lucio Agaceta; and on the
SW., by a ditch and property of Lucio Agaceta. Beginning at a
point marked “1” on plan, being S. 79 deg. 13’E., 4945.75 m.
from B.L.L.M. No. 1, San Fabian,
thence S. 85 deg. 26’W., 84.38 m. to point 2;
thence N. 20 deg. 24’W., 22.63 m. to point 3;
thence N. 81 deg. 44’E., 162.61 m. to point 4;

thence S. 13 deg. 13’E., 18.89 m. to point 5;


thence S. 8 deg. 16’E., 20.29 m. to point 6;
thence N. 86 deg. 27’W., 11.63 m. to point 7;
thence S. 89 deg. 01’E., 64.56 m. to the point of
beginning, containing an area of Four Thousand Six Hundred
and Fifteen Square Meters (4,615), more or less. All points
referred to are indicated on the plan and are marked on the
ground points “1” and “2” are marked by old P.L.S. conc. Mons.;
and the rest by P.L.S. conc. Mons.; bearings true; declination 0
deg. 38’E., date of survey, April 5, 1926.”

PARCEL II - T.C.T. No.T-42065 (Bacnotan, La Union)

“Beginning at a point marked “1” of Lot No. 291, Pls-


1050-D, being N. 26-58 W., 1558.11 m. from BLLM No. I, Pls-
1050-D, thence N. 27-32 W., 67.29 m. to point 2; N. 16-54 W.,
172.70 m. to point 3; S. 84-02 E., 31.15 m. to point 4; S. 69-17
E., 74.45 m. to point 5; S. 31-31 E., 107.59 m. to point 6; S. 6-21
W., 77.19 m. to point 7; S. 80-19 W., 48.00 m. to point 8; S. 46-
19 W., 27.24 m. to point 1, point of beginning; containing an
area of Nineteen Thousand Nine Hundred and Fifty (19,950)
Square Meters. All points are marked on the ground by P.S. cyl.
Conc. Mons. Bounded on the SW., along lines 1-2-3 by National
Road, on the NE., along lines 3-4-5 by Barrio Road, along line 5-
6 by Lot 290, Pls-1050-D; on the E., along line 6-7 by Lot 293,
Pls-1050-D and on the S., along lines 7-8-1 by Lot 292, Pls-
1050-D. Bearings Grid. This lot was surveyed in accordance
with law and existing regulations promulgated thereunder, by
Manuel Añonuevo, Cadastral Land Surveyor, December 7, 1972,
NOTE: This lot is covered by F.P.A. No. (I-I) 3520-B.

PARCEL III – T.C.T. No. T-42764 (Bacnotan, La Union)

“Beginning at a point marked “1” of Lot No. 292; Pls-


1050-D, being N. 26-58 W., 1558.11 m. from BLLM No. I, Pls-
1050-D, thence N. 46-19 E., 27.24 m. to point 2; N. 80-19 E.,
48.00 m. to point 3; S. 77-32 E., 45.90 m. to point 4; S. 9-32 W.,
70.34 m. to point 5; S. 88-12 W., 66.89 m. to point 6; N. 31-27
W., 63.88 m. to point 1; point of beginning. Containing an area
of Six Thousand Nine Hundred and Thirty Eight (6,938) Square
Meters. All points are marked on the ground by PS cyl. Conc.
Mons. Bounded on the NW., along lines 1-2-3 by Lot 291, Pls-
1050-D; on the NE., and SE., along lines 3-4-5-6 by Lot 293,
Pls-1050-D; and on the SW., along lines 6-1 by National Road.
Bearings Grid. This lot was surveyed in accordance with law and
existing regulations promulgated thereunder by Manuel
Añonuevo, Cadastral Land Surveyor on December 5, 1972.
NOTE: This lot is covered by F.P.A. No. (I-I) 3520-A.

PARCEL IV – Tax Declaration No. 13022 (Camp 4, Tuba,


Benguet)

“A parcel of unregistered agricultural land situated at


Camaring, Camp 4, Tuba, Benguet; containing an area of Five
Thousand Square Meters (5000). Bounded on the North by
Creek; on the South by Bayan Alipda; on the East by Arsenia
Perez; and on the West by Erlinda Pablo, with an assessed value
of P2,630.00 recorded with the Provincial Assessor for Benguet
Province.”

3. There are no personal properties involved in this extrajudicial settlement.

4. To the best knowledge and information of the parties hereto the deceased left no
debts.

5. The parties hereto, invoking Sec. 1, Rule 74 of the Rules of Court by these presents
agree to divide and adjudicate, as they hereby divide and adjudicate among themselves the
above-described real properties in the following manner:

A. PARCEL I (T.C.T. No. 210052)

Parcel I is hereby adjudicated in favor of and shall go exclusively to the


surviving spouse, HILDA C. TELLO.

The other heirs hereby waive in favor of said Hilda C. Tello their respective
shares thereon.

B. PARCELS II and III

PARCEL I – One-half (1/2) of this land is hereby adjudicated and shall go to


Eliza Tello-Hansen, Phillis Tello-Hsia, Dibra Tello, Ruth Tello-Rio and Joseph
Tello, while the other half is hereby adjudicated and shall go to Joieda Hope Tello-
Radie, Jesimiel Bas C. Tello and Basanio Tello, Jr., pro-indiviso equal shares.

The said surviving spouse Hilda C. Tello hereby waive her conjugal share and
hereditary share in said Parcel I in favor of the other heirs.

PARCEL II – One half (1/2) of this land is hereby adjudicated and shall go to
Eliza Tello-Hansen, Phillis Tello-Hsia, Dibra Tello, Ruth Tello-Rio and Joseph
Tello, while the other half is hereby adjudicated and shall go to Joieda Hope Tello-
Radie, Jesimiel Bas C. Tello and Basanio Tello, Jr., pro-indiviso equal shares.

The said surviving spouse Hilda C. Tello hereby waive her conjugal share and
hereditary share in said Parcel II in favor of the other heirs.

B. PARCEL IV

The entire PARCEL IV shall go to and belong to all the undersigned heirs of
the deceased Basanio Tello.

The parties further agree that if in the future other properties of the deceased
are discovered, they shall likewise be settled in the manner done in this instrument.

This instrument relates to an Extrajudicial Settlement of Estate of the Deceased


Basanio Tello of four parcels of land located at Pangasinan, La Union and Benguet Province,
which consists of four (4) pages including this page whereon the acknowledgment is written.
The same has been signed by the parties and their instrumental witnesses on each and every
page hereof.
