1.0 Background

Section 14 (b) and (c) of Republic Act No. 10066, otherwise known as the "National Cultural
Heritage Act of 2009"' requires local government units to establish and mainain a local
cultural property registry.

ln line with the above purpose, local inventory of cultural property is a compliance to RA
10055, that will serve the Philippine Registry of Cultural Property (PRECUP) as the regisrry
of all cultural property.

2.0 Purpose

This Circular aims to enjoin all local government units to establish and maintain a local
inventory of cultural property.

3.0 Definition of Terms

a. Cultural property - refers to all products of human creativity by which a people

and a nation reveal their identity. including churches, mosques and other places
of religious worship, schools and natural history specimens and sites, whether
public or privately-owned, movable or immovable, and tangible or intangible.

b. World Heritage Site - refers to properties inscribed by UNESCO on the World

Heritage List. As of 2076, these include the Rice Terraces of the Philippine
Cordilleras (Bangaan, Batad, Hungduan, Mayoyao and Nagacadan), Historic
Town of Vigan, Baroque Churches of the Phlippines (Paoay, Santa Maria, San
Agustin in Manila, and Miag-ao). Puerto Princesa Subterranean River National
Park, Tubbataha Reefs Natural Parh and Mount Hamiguitan.

c. Natural Cultural Treasure - refers to a unique cultural property fbund locally,

possessing outstanding historical, cultural, artistic and/or scientific value which
is highly significant and important to the country and nation, and officially
declarcd as such by pertinent cultural agency.

d. lmportant Cultural Property - refers to a cultural properly having exceptional

cultural, artistic and historical significance to the Philippines, as shall be
determined by the National Museum and/or National Historical Commission of
the Philippines (RA No, 10065).

e. Heritage Zone - refers to historical, anthropological, archaeological, artistic

geographical areas and settings that are culturally significant to the country, as
declared by the National Museum and/or the National Historical Commission of
the Philippines (RA No. 10066).

f. National Historical Landmarks - refers to sites or structures which are

associatedwith events or achievements significant to Philippine history
declared as such by the NCHP (RA Nos. 810066/10085).

g. National Historical Monuments - refers to struchrres erected as a memorial to

great heroes or events in Philippine history declared as such by the NHCP IRA
Nos. 10066/10085)

h. National Historical Shrines - refers to sites or srructures hallowed and revered

for their history or association declared as such by the NHCP (RA Nos.
1 0066/r0086)

i. Heritage Houses - refers to houses of ancestry with notable historical, cultural,

social, architectural and artistic value and significance as declared by the NHCP
IRA No. 10086).

j, Historic Site - refers to a place recognized to have an important historical

significance as declared by the NHCP (RA No. 10086)

k. Classified Historic Structure - refers to structures and sites marked and listed as
such and recorded in the National Historical Commission of the Philippine's
National Registry of Historic Sites and Structures, and not falling under any of
the five (5) categories of historic sites and structures, namely: National Shrines,
National Monuments, National Landmarks, Heriuge Houses and Historic Sites.

L Presumed Important Cultural Properties - refers to cultural properties that not

have been officially declared but are presurned to be declared Important
Cultural Properties, which include the following:

t, Works by a National Artist (i.e. structures designed by luan Nakpil, Pablo

Antonio, Leandro Locsin, and Jose Maria Zaragoza; landscapes designed
by lldefonso P. Santos; Iixed sculptures or monuments created by
Guillermo Tolentino, Napoleon Abueva, Abdulmari Imao, etc.);

il. Marked structures (i.e. structures rvith markers from the National
Historical Commission of the Philippines and its predecessors: National
Historicat Institute, Philippine HistoricaI Committee, and the Historical
Research and Markers Committee); and

iii. Structures dating at least fifty (50) years old.

4.0 Scope/Coverage

All Provincial Governors, City Mayors, Municipal Mayors, Punong Barangays, DILG Regional
Directors, ARMM Regional Governor, and all others concerned.

S.0 Poliry Content and Guidelines

5.1 All Local Chief Executives are enjoined to undertake the following:

5.1.1 ldentiff cultural property as provided in Section 3, (fJ and [x], of RA No.
10066, quote:

t0 "Built heritoge" shall refer to architectural and engineering structures such

as, but not limited to, bridges, government buildings, hoases of ancescry,
traditional dwellings, quortels, troin stations, lighthouses, small por*,
educational, technological ond industrial complexes, and their settings,
and landscopeswith notqble historical and cultural significance.

{x) "lntangible culturol heritage" shall refer to the proctices, representotions,

expressions, knowledge skrlls - as well ss the instruments, objects and
artifocts associated therewith, that communities, groups, ond individuals
recognize as part of their cultural heritoge, such as (1) oral traditions,
longuages and expressions; (2) performing arts; (3) social practices,
rituals, and festive events; (4) knowledge and practices concerning noture
and the untverse; and croditional croftsmanship;
 5.L.2 Maintain a local inventory of all cultural property within the jurisdiction,
through their local offices;

5.1.3 Coordinate regularly with cultural agencies in rnaking entries and monitor
various cultural properties;

5.1,4 Enjoin private collectors and owners of cultural property to register such
properties and shall not be divested of their possession and ownership even
after registrarion ofsaid property, as required;

5.1.5 See to it that all registered information of cultural properties owned by

private individuals shall remain confidential and may be given only upon
prior consent of the private owner;

5.1.6 Create programs and budgets for the conservation and preservation
of culfural property in their environmental, educational and cultural
activities that provides discretion to LGUs;

5.1.7 Request the NCCA to provide technical assistance and training for cultural
mapping activities;

5,1.8 Maintain declared Heritage Zones of concerned local government unit, as

provided under Section 13, ofRA 10066; and

5.1.9 Ensure that penalties on prohibited acts under Section 48 of RA 10056 are
enfiorced.

6.0 Reportorial Clause

Submit partial or full completed registry forms from the NCCA for built heritage (Annex
"A"), and intangible cultural heritage and its guide (Annex BJ, to the Philippine Registry of Cultural
Property (PRECUP) through :
