NOTICE INVITING TENDER

GOA INDUSTRIAL DEVELOPMENT CORPORATION

e – TENDERINGMODE e-PAYMENT ONLY

Percentage rate tenders are invited on behalf of the The Managing Director from approved and
eligible contractors of CPWD, any state PWD and Goa-PWD registered in appropriate class and
category for the work of “Construction/Strenghtening of Retaining wall near plot No. 08,
09 and 60 at Kakoda Industrial Estate.”

The enlistment of the contractors should be valid on the last date of submission of
tenders.

In case the last date of submission of tender is extended, the enlistment of contractor
should be valid on the original date of submission of tenders.

In case both the last date of receipt of application and submission of tenders are
extended, the enlistment of contractor should be valid on either of the two dates, i.e.,
original date of submission of tender or on the extended date of submission of tenders.

1.1 The work is estimated to cost Rs. 46,56,668/-.

1.1.1 The authority competent to approve NIT for the combined cost and belonging to the
major discipline will consolidate NITs for calling the tenders. He will also nominate
Engineering section which will deal with all matters relating to the invitation of tenders.

Criteria of eligibility for issue of tender documents

1.2.1 Tender forms shall be issued online to intending tenderers registered in appropriate
class & category of CPWD, any state PWD and Goa-PWD, after verification of scanned
copies of i) Attested copy of valid Registration ii) Attested copy of income tax PAN
card iii) Attested copy of VAT/GST registration.

1.2.2 The registered contractor in CPWD, any state PWD and Goa-PWD, either individual,
partnership firm or Company who have four or more works in hand in their names in
the appropriate class, shall not be entitled to have any fresh tender forms for further
works in the same category unless they complete at least one work out of four in hand.

1.2.3 The enlistment of a contractor in CPWD, any state PWD and Goa-PWD, shall only entitle
him to be considered for issue of tender papers subject to the conditions laid down in
individual Notice Inviting Tender. It shall not confer any right on him either to be
necessarily issued the tender papers or for award of work.

1.2.4 For work mentioned above, the interested contractors who wish to participate in the e-
tender has to scan and upload the following documents mentioned below at the time of
application of tender documents to e-tendering website www.tenderwizard.com/goa
on 12/11/2019 up to 04.00 hrs p.m.

i) Attested copy of valid Registration.

ii) Attested copy of PAN card.

iii) Attested copy of VAT/GST Registration certificates

iv) Declaration giving the names of works in hand till date on Rs.50/- stamp
paper duly signed by the agency. The contractor having four or more works
in hand in the same category of work in their name or firm’s name may not
apply. Such application will be rejected. The contractor shall submit list of
works which are in hand (Progress) as per Annexure-A:

1.2.5 Tender papers shall not be sent by post.


1.2.6 The estimate is based on Goa Schedule of Rates 2019 (Buildings ).
1.2.7 The tender document for the above mentioned works are available in the office of The
General Manager (Engg.), Engineering Section, Goa Industrial Development
Corporation, Panaji-Goa.
1.2.8 Issue of tender forms will be stopped two days before the date fixed for the opening of
tenders.
2. Agreement shall be drawn with the successful tenderer on prescribed form No. 8 (or
other Standard Form as mentioned). Tenderer shall quote his rates as per various
terms and conditions of the said form which will form part of the agreement.
3. The time allowed for carrying out the work will be 90 days (including Monsoon).
4. The site for the work is available.
5. Online applications for Tender up to 04.00 hrs p.m. on 12 /11/2019 and online
submission for Tender up to 04.00 hrs p.m. on 14 / 11 /2019.
Tender documents consisting of specifications, the schedule of quantities of various
types of items to be executed and the set of terms & conditions of the contract to be
complied with and other necessary documents can be seen from website
www.tenderwizard.com/GOA free of cost and for participation in e-tender, tenderers
may please visit our e-tender website www.tenderwizard.com/GOA.Those contractors
not registered on the website mentioned above are required to get registered
beforehand. The intending bidders must have valid digital signature to submit the bid.

6. The bidders participating for e-tendering/ e-payment mode has to remit tender
processing fee, tender documents fee and Earnest Money Deposit (EMD) through
online payment gateway on portal www.e-tender.goa.gov.in

(i) e-tender processing fee of Rs. 4,000.00/- (non refundable).

(ii) Tender documents fee of Rs.3000.00/-(non refundable).

(iii) Earnest Money Deposit of Rs.93,133 /-

Only the online tender documents submitted by those intending bidders who have
remitted Earnest Money Deposit, tender document fee and e-tender processing fee
online within specified time shall be opened (No physical documents shall be
accepted).

a. Bidders participating for e-Tendering have to remit Tender Processing Fee (TPF),
Tender Document Fee (TDF) and Earnest Money Deposit (EMD) through online
Payment Gateway on portal www.etender.goa.in through following four modes of
payment:
a. National Electronic Fund Transfer (NEFT) / Real-Time Gross Settlement
RTGS) / Axis Bank Over-the-counter (OTC). Tenderer requires download
pre-printed Challan towards credit of ITG available on e-tender website
and make its payment through any of their Bank.
b. Internet Payment Gateway (Debit/ Credit Card of type VISA, MATERCARD
or RuPay.
c. Net Banking: Payment can be made through the Internet Banking of Any
Bank.
Note: Any Payments made through NEFT/RTGS/OTC will take 24 hours for its reconciliation. Hence
the payments through NEFT/RTGS/OTC should be made at least TWO BANK WORKING DAYS in
advance before any due date and upload the scanned copy of challans in the e-Tender website as a
token of payment

7. The Contractor whose tender is accepted will be required to furnish performance


guarantee of 5% (Five Percent) of the tendered amount within the period specified in
time. The guarantee shall be in the form of Demand Draft /Pay order of any
Scheduled/Nationalized Bank or Bank Guarantee of any Scheduled /Nationalized Bank
in accordance with the prescribed form. In case the contractor fails to deposit the said
performance guarantee within the specified period including the extended period, if any,
the Earnest Money Deposited by the contractor shall be forfeited automatically without
any notice to the contractor.

8. The tender for the work shall remain open for acceptance for a period
of 90 days from the date of opening of the tender. If any tenderer
withdraw his tender before the said period or makes any modifications
in the terms and conditions of the tender which are not acceptable to
the Department / GOA - IDC then the GOA - IDC shall without prejudice
to any other right to remedy is at liberty to forfeit the entire amount of
the (EMD) Earnest Money Deposit in the first instance. If such
withdrawal is repeated then the tenderer will also be liable for
blacklisting after issue of proper "SHOW CAUSE NOTICE".

The description of the work is as follows: -

“Construction/Strenghtening of Retaining wall near plot No. 08, 09 and 60 at Kakoda


Industrial Estate.”

Copies of other drawings and documents pertaining to the work will be open for
inspection by the tenderers at the office of the Goa Industrial Development Corporation
Panaji-Goa.

Intending tenderers are advised to inspect and examine the site and its surroundings and
satisfy themselves before submitting their tenders as to the nature of the ground and sub-
soil (so far as is practicable), the form and nature of the site, the means of access to the
site, the accommodation they may require and in general shall themselves obtain all
necessary information as to risks, contingencies and other circumstances which may
influence or affect their tender. A tenderer shall be deemed to have full knowledge of the
site whether he inspects it or not and no extra charges consequent or any
misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for
arranging and maintaining at their own cost all materials, tools & plants, water,
electricity, access facilities for workers and all other services required for executing the
work unless otherwise specifically provided for in the contract documents. Submission of
a tender by a tenderer implies that he has read this notice and all other contract documents
and has made himself aware of the scope and specifications of the work to be done and of
conditions and rates at which stores, tools and plant, etc., will be issued to him by the
Government and local conditions and other factors having a bearing on the execution of
the work.

9. The competent authority on behalf of the Goa Industrial Development Corporation


does not bind itself to accept the lowest or any other tender and reserves to itself the
authority to reject any or all the tenders received without the assignment of any
reason. All tenders in which any of the prescribed condition is not fulfilled or any
condition including that of conditional rebate is put forth by the tenderer shall be
summarily rejected.

10. Use of correction fluid anywhere in the tender document is not permitted. Such tender
is liable for rejection.

11. Canvassing whether directly or indirectly, in connection with tenders is strictly


prohibited and the tenders submitted by the contractors who resort to canvassing will
be liable to rejection.

12. The competent authority on behalf of Goa Industrial Development Corporation


reserves to himself the right of accepting the whole or any part of the tender and the
tenderer shall be bound to perform the same at the rate quoted.

13. The contractor shall not be permitted to tender for works in the Goa – IDC
(responsible for award and execution of contracts) in which his near relative is posted
as Asst. Accounts Officer or as an officer in any capacity between the grades of
General Manager (Engg.) and General Manager (both inclusive). He shall also
intimate the names of persons who are working with him in any capacity or are
subsequently employed by him and who are near relatives to any gazetted officer in
the Goa Industrial Development Corporation. Any breach of this condition by the
contractor would render him liable to be removed from the approved list of
contractors of his Department.

14. No Engineer of gazette rank or other Gazetted officer employed in Engineering or


Administrative duties in an Engineering Department of the Government is allowed to
work as a contractor for a period of one year after his retirement from Government
service, without the previous permission of the Government of India in writing. This
contract is liable to be cancelled if either the contractor or any of his employees is
found any time to be such a person who has not obtained the permission of the
Government as aforesaid before submission of the tender or engagement in the
contractor’s service

15. The tender for the work shall not be witnessed by a contractor or contractors who
himself/ themselves has/have tendered or who may and has / have tendered for the
same work. Failure to observe this condition would render tenders of the contractors
tendering as well as witnessing the tender liable to rejection.

16. It will be obligatory on the part of the tenderer to tender and sign the tender
documents for all the Components parts and that, after the work is awarded,
he will have to enter into an agreement for each component with the competent
officer concerned viz: Managing Director / General Manager (Engg.)
17. This Notice Inviting Tender shall form a part of the contract document. The
successful tenderer/ contractor, on acceptance of his tender by the Accepting
Authority shall, within 15 days from the stipulated date of start of the work, sign the
contract consisting of:

(a) The notice inviting tender, all the documents including additional conditions,
specifications and drawings, if any, forming part of the tender as uploaded at the
time of invitation of tender and the rates quoted on-line at the time of submission
of bid and acceptance thereof together with any correspondence leading thereto.

(b) Standard C.P.W.D. Form 8 or other Standard C.P.W.D. Form as mentioned.

(c) Notice inviting bids as published in the newspaper shall not form part of NIT/ Bid
documents.

18. In case, it is found that e-payment made is bogus, then the contractor, (He/They) shall
be weeded out from the approved contractors list of the Government and criminal
action will be initiated against (Him/Them) for the offence.

19. As per Section 51 of GoaGoods And Service Tax Act, 2017(SGST) and section 51 of Central
Goods And Services Tax Act, 2017(CGST) Goa Industrial Development Corporation shall
recover the TDS at the rate of 2% (i.e. 1% CGST and 1% SGST) on the value of work contract
undertaken by the agency. Any other tax/Octroi applicable shall be borne by Agency.

20. The Contractor upon acceptance of tender should get himself registered under
GoaGoods And Service Tax Act, 2017(SGST) and section 51 of Central Goods And Services
Tax Act, 2017(CGST) and true copies of the certificates of such valid registrations
should be filed with this office, before issue of Work Order, which will form part of
the agreement.

21. Labour Welfare Cess @ 1% shall be deducted on the value of work-contract from R.
A. Bills at source as per the provision of the building and other construction worker’s
Regulation of Employment & Conditions of Service Act 1996.

22. The contractor shall comply with the provisions of the payment of wages Act, 1936,
Minimum Wages Act, 1948. Employees Liability act, 1938, workmen’s
Compensation Act, 1923, Industrial disputes Act, 1947, Maternity Benefits Act 1961
and the Contractors Labour (Regulation and Abolition) Act, 1970. the Employees
Provident Funds and Miscellaneous Provisions Act, 1952 or the modifications thereof
or any other laws relating thereto and the rules made there under from time to time.

23. Special care should be taken to write the rates in figures as well as in words, and the
amounts in figures only in such a way that interpolation is not possible. The total
amount should be written both in figures and in words. In case of figures, the word
'Rs.' should be written before the figure of rupees and words 'P' after the decimal
figures 'e.g. Rs. 2.15 P.' and in case of words the word 'Rupees' should precede and
the world "Paise' should be written at the end. Unless the rates are in whole rupees
and followed by the words 'only' it should invariably be upto two decimal places.
While quoting the rate in schedule of quantities, the word 'only' should be written
closely following the amount and it should not be written in the next line.

24. The tenderer, apart from being a Class- IB – RBLD/BLDG & ABOVE contractor,
must associate himself with agencies of the appropriate class which are eligible to
tender for (i) Electrical (ii) Sanitary and Water Supply Installations and (iii)
Horticulture.

25. The contractor's responsibility for the contract shall commence from the date of issue
of orders of acceptance of tender.

26. All the tenders will be dealt in accordance with P.W.D. circular No. 1-8-07/SSW/-
PWD-Vol.I/2007-08/522 dated 12/11/2007.

------------------- SPECIAL CONDITIONS ------------------

1. Payment for the work done will be made subject to the availability of funds
without any additional liability of interest.
2. Pre-cast slabs should be procured from approved manufacturers only.
3. Payments towards items involving use of asphalt will be released to the
maximum extent of 90% on completion of these items and the balance will be
released on completion of other items not involving the use of asphalt.
4. The rates quoted by the contractor should be exclusive of GST.
