JUDICIAL AFFIDAVIT
OF
POLICE CORPORAL RYAN CABODBOD

This Judicial Affidavit of Ryan Cabodbod, the Police Officer who

conducted the rape investigation, is executed to serve as a testimony to the
instant case.

PRELIMINARY STATEMENT

This Judicial Affidavit was taken at the office of Atty. John Ville
Dabatos office address at 2nd floor J Centre Mall Brgy. Bakilid, Mandaue
City. Questions were propounded by the same and the examination was
conducted in English and Filipino, the languages that were used and
understood by the Affiant.

a. That I am at the police officer who was the investigation on case of

the rape on March 21, 2021 at 727 A.S Fortuna St, Mandaue City,
Cebu.
b. That I saw the medical certificate of the victim that she was raped and
I concluded and recommended that criminal charges be filed against
the accused.
c. That I filled a criminal complaint against the accused Jesus Levy T.
Dacera before Reginal Trial Court Branch 58 of Cebu City.

Affiant answered each question fully conscious that she did so under oath
and may face criminal liability for false testimony and perjury.

Q1: Please state your name, age, address and other personal
circumstances for the record.

A1: I am Police Corporal Ryan Cabodbod, 25 years of legal age, Married

and currently residing at Canduman Housing Mandue City Cebu, I am
one of the police officers who responded at the scene of the crime on
March 21, 2021.

Q2: From which station did you receive the information about the
crime which took place on the night of March 21, 2021?
A2: It was on Mandaue Police Station 3, Sir, and the nearest police station
nearest in the crime scene.

Q3: Were you at the station when you receive the call about a rape
happening in Andy Hotel?

A3: No. we were at the outside of the motel we park our patrol car at that
time Sir.

Q4: From whom did you receive the call?

A4: From a Miss Codillo, she runs towards us and she states what happen
Sir.

Q5: What about the victim?

A5: She was taken to the hospital for medical examination. Sir

Q6: And who is the name of the victim Mr. Cabodbod?

A6: Miss Mabelyn Codillo, Sir.

Q7: When you saw Mr. Dacera what did you do?
A7: He tried to run and we caught him. Sir

Q8: Can you describe what you saw at the crime scene?
A8: Yes, Sir. The victim was running towards us. She is very scared and
crying she told us that she was raped.

Q9: What did you do to the accused?

A9: We took him to the station Sir.

Q10: What is the name of the accused?

A10: Mr. Jesus Levy T Dacera.

Q11: What were the statements of Mr. Dacera regarding the crime?
A11. He didn’t confess about that crime sir.

Q12: Can you possibly relate his statements based on the police records of
the investigation?
A12: In his, statement that he didn’t rape Miss Mabelyn Codillo, he
said that he only wants to help Miss Codillo because she is drunk at
that time, he said also that Miss Codillo said that “Will you not stay
with me?” after that he stayed in her room and he went to the
bathroom and Miss Codillo follow her and suddenly Miss Codillo

grabbed his belt and she blowjob. And Mr. Dacera resist and she did it
again.

Q13: Do you have a medical result?

A13: Yes, Sir

Q14: Can you show us what the result of the examination are?
A14: Yes, Sir Based on the medical result of the victim that the Internal
Examination: Multiple bruises of variable sizes over neck muscles, both the
sides of neck at places more towards the nape of the neck were present.
Petechial hemorrhages over pleura, 359 pericardium and
Renal capsule with congestion of all viscera.

Genital Findings: Bruises on labia minora, recent hymnal tears at 5 and 7

o’clock position with oozing of blood
with a tear of the posterior fourchette.
Anal Findings: Two small linear abrasions extending from anal margin into
the anus with
Dilatation (3.5x2cm size) and a bruise at its right margin with
Laceration of size (1.5x0.5) cm and fissure was seen around the anus.

Q15. Based on your interview and investigation, what were your

findings?
A15. As the result of the medicial examination it is proved that accused
committed the crime rape happen at the Andy Hotel.

Q16. What where your conclusions?

A16. Considering the facts and circumstances, I concluded that the accused
Mr. Jesus Levy T. Dacera, was observed to be a crime violation chapter
three Article 266 of Revised Penal Code for Rape.

Q17. What were your recommendation?

A17. I recommend that the case must be filed at the Regional Trial Court for
proper hearing for the case.

Q18: In connection to this case do you remember having executed a

judicial affidavit?

18. A: Yes, Sir.

19Q: Is this the judicial affidavit?

19A: Yes, Sir.
