Re: Terms of Engagement

Dear Juan Gonzalez:

This Engagement Letter sets forth the agreement between Dawson & Associates PLLC (the
“Firm”), and Juan Gonzalez (“You”). We appreciate the opportunity to represent You and look
forward to continuing our professional relationship. The purpose of this letter is to confirm our
engagement as counsel and to provide You information concerning our fees, billing, and collection
policies, as well as other terms on which we propose to represent You.

I. Scope of Engagement

You have engaged the Firm to act as counsel in connection with Injuries received on
November 13th during collision with Richard Jones (the “Case”). The scope of our engagement is
limited to this matter and, unless we agree to do so in writing, does not include representation in
connection with any post-trial or appellate matters.

II. Fee Arrangement

You have agreed to reimburse the Firm for all legal expenses associated with this case unless
or until notified otherwise. For this matter, [we will bill hourly for services. My billing rate is
$750.00 per hour. Billing rates for other attorneys will be less than that rate, and our legal assistants
bill at $350.00 per hour. We periodically adjust our billing rates to reflect the experience and
expertise of our attorneys. Of course, any such changes in rates are applied prospectively only. We
record and generally bill our time in one-tenth hour (i.e., six minute) increments. At this time, we
know of no conflicts between any adverse party and any of our clients, but should You become
aware of any please notify us immediately.

We do not know and cannot determine in advance the ultimate cost of handling this Case
since we do not know at this time (i) all of the facts, circumstances and legal issues concerning the
Case, (ii) the amount of factual investigations and legal research that may be required to prepare the

Case, or (iii) the extent of discovery, court proceedings, and other actions that may be taken by other
parties in connection with the Case.

III. Expenses

In addition to legal and filing fees, our statements may include out-of-pocket expenses that
we have advanced on Your behalf. Those expenses may typically include, among other things:
travel, electronic filing and service, PACER, facsimile transmissions, postage, messenger services,
overnight and courier services, charges for complex document production, and charges for
photocopying or printing materials sent to the client or third parties or otherwise required for our use.

During our representation, it may also be appropriate or necessary to engage third parties to
provide services on Your behalf. These services may include such things as consulting or testifying
experts, investigators, providers of computerized litigation support, court reporters, providers of
filing services and searches of governmental records and filings and local counsel. Because of the
legal “work product” protection afforded to services that an attorney requests from third parties, our
firm may assume responsibility for retaining the appropriate service providers, which will then be
passed along to You.

IV. Your Right to Control Settlement

We are authorized to negotiate compromises and settlements of Your claims, but You retain
final control, and no authority is hereby given us to settle. Any settlement offer will be conveyed to
You with our recommendation for acceptance or rejection.

V. Choice of Texas Law and Arbitration Provision

OUR AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF


TEXAS AND ALL DISPUTES RELATED DIRECTLY OR INDIRECTLY TO ANY ASPECT
OF OUR REPRESENTATION OR RELATIONSHIP OF ANY OF OUR MEMBERS,
ATTORNEYS, THEIR EMPLOYEES, OR EMPLOYEES OF THE FIRM WITH YOU
SHALL BE ARBITRATED IN DALLAS, TEXAS.

VI. Notice to Clients

THE STATE BAR OF TEXAS INVESTIGATES AND PROSECUTES


PROFESSIONAL MISCONDUCT COMMITTED BY TEXAS ATTORNEYS. ALTHOUGH
NOT EVERY COMPLAINT AGAINST OR DISPUTE WITH A LAWYER INVOLVES
PROFESSIONAL MISCONDUCT, THE STATE BAR’S OFFICE OF GENERAL COUNSEL

VII. No Oral Modification of this Agreement

The terms of this agreement may only be modified by a written modification signed by all
parties. We cannot advise You concerning this engagement agreement and we recommend that You
seek other counsel for the purpose of reviewing this agreement prior to executing it.

VIII. Conclusion

We look forward to representing You in this matter, and we are pleased that You have chosen
us. To signify Your agreement to the terms and conditions set forth in this engagement letter, please
