Defendant.

The State of Utah, through the undersigned prosecutor, alleges Lawrence Frassoldati
committed the following criminal offense(s) in Millard County Utah:

COUNT 1: ASSAULT AGAINST A PEACE OFFICER OR MILITARY SERVICE MEMBER,


a second degree felony, in violation of 76-5-102.4(4), in that Lawrence Frassoldati on or about
April 29, 2021 did assault a peace officer, with the knowledge that the person was a peace
officer, when the peace officer was acting within the scope of his authority as a peace officer,
and used other means or force likely to produce death or serious bodily injury.

COUNT 2: ASSAULT AGAINST A PEACE OFFICER OR MILITARY SERVICE MEMBER,


a second degree felony, in violation of 76-5-102.4(4), in that Lawrence Frassoldati on or about
April 29, 2021 did assault a peace officer, with the knowledge that the person was a peace
officer, when the peace officer was acting within the scope of his authority as a peace officer,
and used other means or force likely to produce death or serious bodily injury.
COUNT 3: THREAT OF TERRORISM, a second degree felony, in violation of 76-5-
107.3(1)(b)(i), in that Lawrence Frassoldati on or about April 29, 2021 did threaten to commit
any offense involving bodily injury, death, or substantial property damage, and acted with intent
to intimidate or coerce a civilian population or to influence or affect the conduct of a government
or a unit of government.

COUNT 4: DISARMING A POLICE OFFICER - ENERGY DEVICE, a third degree felony, in


violation of 76-5-102.8(3)(b), in that Lawrence Frassoldati on or about April 29, 2021 did
intentionally take or remove, or attempt to take or remove a conductive energy device from the
person or immediate presence of a person the defendant knew was a peace officer, without the
consent of the peace officer, and while the peace officer was acting within the scope of his
authority as a peace officer.

COUNT 5: ASSAULT AGAINST A PEACE OFFICER OR MILITARY SERVICE MEMBER,


a class A misdemeanor, in violation of 76-5-102.4(2), in that Lawrence Frassoldati on or about
April 29, 2021 did assault a peace officer, with the knowledge that the person was a peace
officer, when the peace officer was acting within the scope of his authority as a peace officer.

COUNT 6: PURCHASE, TRANSFER, POSSESSION OR USE OF A DANGEROUS


WEAPON BY RESTRICTED PERSON, a class A misdemeanor, in violation of 76-10-503, in
that Lawrence Frassoldati on or about April 29, 2021 did, being then a category II restricted
person, intentionally or knowingly purchase, transfer, possess, use, or have under the person's
custody or control, any dangerous weapon other than a firearm.

COUNT 7: PURCHASE, TRANSFER, POSSESSION OR USE OF A DANGEROUS


WEAPON BY RESTRICTED PERSON, a class A misdemeanor, in violation of 76-10-503, in
that Lawrence Frassoldati on or about April 29, 2021 did, being then a category II restricted
person, intentionally or knowingly purchase, transfer, possess, use, or have under the person's
custody or control, any dangerous weapon other than a firearm.

COUNT 8: INTERFERENCE WITH ARRESTING OFFICER, a class B misdemeanor, in


violation of 76-8-305, in that Lawrence Frassoldati on or about April 29, 2021 did have
knowledge, or by the exercise of reasonable care should have knowledge, that a peace officer
was seeking to effect a lawful arrest or detention of the defendant or another and interfered with
the arrest or detention by, the use of force or any weapon; refusing to perform any act required
by lawful order necessary to effect the arrest or detention; and made by a peace officer involved
in the arrest or detention; or refusing to refrain from performing any act that would impede the
arrest or detention.

COUNT 9: POSSESSION OR USE OF A CONTROLLED SUBSTANCE, a class B


misdemeanor, in violation of 58-37-8(2)(d), in that Lawrence Frassoldati on or about April 29,
2021 did knowingly and intentionally possess or use a controlled substance analog or a
controlled substance without a valid prescription (Marijuana).
COUNT 10: POSSESSION OF DRUG PARAPHERNALIA, a class B misdemeanor, in
violation of 58-37a-5(1), in that Lawrence Frassoldati on or about April 29, 2021 did use, or
possess with intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest,
manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store,
contain, conceal, inject, ingest, inhale or otherwise introduce a controlled substance into the
human body in violation of Utah Code Title 58, Chapter 37a.
