4. By referring to Clause 48: Defects After Completion, Standard Form of Contract P.W.D. Form 203
(Rev. l/2010):
i. Explain the meaning of Defect Liability Period (CLOI, C3)

Under provision Clause 48 DLP is a period where Contractor shall make good the
defects at his own costs against any defect, imperfection, shrinkage or any other faults
which may appear and which are due to materials or goods or workmanships not in
accordance with this contract.
DLP is stated in the Appendix (if not stated is six (6) months after Date of Practical
Completion). Common practice is 12 - 18 months unless some other period speoifiod in
the Appendix.
ll Determine the action that will be taken by S.O. due to any defects or imperfection occws
during the Defect Liability Period. (CLOI, C3)

o S.O. shall specifu in Schedule of Defects and deliver to Contractor not less than 14
days after the expiration of DLP. Contractor shall make a good not later than three
(3) months after the receipt of the said Schedule.
o If the Contractor failed to comply with the Clause 48.1 (a) and/or 48.1 (b) S.O. may
departmentally or employ others to make good the defects and deduct ftom:
- Remaining sum to be paid to the Contractor

o When Contractor has made good all defects, S.O. shall issue "Certifrcate of
Completion of Making Good Defects" on the date.

i. The Govemment shall keep indemnified bythe contractor against all penalties and liability of
every kind of breach of any such statutory Requirements. (clol, c3)
