Greetings!
I am from Cebu and just wish to settle here in B colod City for this place is my mother's
hometown. A teacher at Bacolod City National igh School and luckily bought a house
and lot in this Akina Plains Subd. Mansilingan. T ere had been so many boarding houses
that lived and decided to purchase a lot of PAG I IG which is suited to my budget. It takes
six years of waiting for this house since the deve aper delayed the construction for almost
two years since the equity of this property was id last year 2018.
Upon occupancy last September 1, 2020, the nknown foul odor was smelt by us and
wonder where it came from and found that it is f om the back of our unit that surprisingly
there are people from the adjacent subdivis n which is known as Purity Homes
Subdivision which is accredited by DHSUD. hese people are illegal settlers which
converted into urban poor, but they should abid to HLURB regulations. The developer
filed a complaint to this Captain Rodolfo T. Pico, a barangay captain here in Mansilingan
but just taken for granted and when I followed it up, he told me that this Mario Luzuriaga
who filed the complaint is not liable to do so a d it should be me to file as a property
buyer. Upon filing a complaint, this barangay cap ain took it for granted that I asked DYRL,
radio station to let Pico had a settlement betwee this poultry and hog raisers.
If I'm not mistaken, I noticed biases on this bar ngay captain since the process delayed
and I filed another complaint to the city mayor. on. Evelia Leonardia and the DENR but
to our dismay, upon execution of the city legal, t ey were stopped due to this Pico called
for another meeting just to delay the eviction o these poultry and piggery inside Purity
Homes Subdivision last January 29 2021 . (Atta ed agreement between Pico and Akina
representative). As homeowner, I didn't attend his meeting anymore for I had another
complaint last December 2020 but Pico told m that it is already a mockery in our part
since we agreed that these poultry and piggery aisers had already put a septic tank but
there is still foul odor emitted and he just endorse it to DENR and City Health. City Health
and DENR endorsed this problem to City Lega already and had acted their inspection
last March 4, 2021 but due to this agreement o Pico ang Akina Subd, they stopped the
eviction of these piggery and poultry just attach d to the back of our unit.

Aguilar iMpected tne abovementioned area. The ro asked around the when:about;S of the
abovementione-0 individuals arid managed to ga er more individual!!: raising pigs in the
area, to wit:

The Team coordinated with the barangay and fou d out that there was already an agreement
between parties that happened during their 2 nd h aring last January 29, 2021. Acopy of the
minutes of the meeting of the 2nd hearing w s given to the team for reference and
information. As stated in the minutes, the fi st 6 individuals above listed, Julie Ann
Bartolome and Arch. Paul Baldava, representativ s of Akina Subdivision wet"e 1>resent. Both
parties agreed that pigpens along the creek stopp dits operation and was advised to transfer
to another place away from the subdivision and e transfer should be made within 45 days
starting th~t day, January 29, 2021.
