Subject : WAIVER OF RIGHTS AND ADMISSION OF RESPONSIBILITIES OVER

THE REWORK OF PRODUCTS

Greetings!

Referring to the manufacturing order and/or agreement for the manufacturing of the product
(name of product, ), as product-owner, we declare that:

I. We acknowledge that we designed the label of the primary (sachet) and secondary (trade
box) packaging materials as well as the labeling information contained therein of the product
mentioned above, and which were produced upon our order.
II. As such, we assume the responsibility to comply with the Food and Drug Administration
(FDA)
labeling requirements as stated in the following directives, to wit;

A. FDA AO 2014-0030. Revised Rules and Regulation Governing the Labeling of Pre-packaged
Food Products;
B. FDA MC 2013-030. Guidelines on the Use of FDA Logo and Name in Promotional,
Advertisement, Sponsorship, Marketing or Commercial Materials; and
C. FDA AO 2010-0008. Directive Specific to the Change in the Use of “No Approved
Therapeutic Claim” in all Advertisement, Promotional and/or Sponsorship Activities or
Materials Concerning Food/Dietary Supplement
such as but not limited to :
(1) The removal or deletion of misleading declaration/representation/probihited claims;
(2) The appropriate product name;
(3) The complete and accurate list of ingredients in descending order of proportion;
(4) The declaration of correct net weight format;
(5) The declaration of the preparation direction that corresponds with the direction
stated on the primary packaging (sachet).
(6) The removal of FDA logo;
(7) The removal of Halal logo unless a Halal Certificate is provided.
(8) The removal of the phrase “No approved therapeutic claims”.
 III. We agree to indemnify Silver Star for any liability that may result out of the use of the
trade boxes which are not in compliance with the above mentioned
regulations if and when decided by the FDA; as well as hold Silver Star free from any
claim or liability that may arise out of the use of the said non-compliant packaging
materials.

IV. With this declaration, we reiterate our order for Silver Star to manufacture the above-
mentioned product using the non-compliant packaging materials with the current
inventory stated below until exhausted, to wit:
 Secondary Packaging Materials (trade box) ______10,000____ pieces.
