2. Explain the Doctrine of Fixtures and determine the


character of the following properties :

· 3. Explain and distinguish between Spes Successions and


Doctrine of feeding the grant by Estoppel.

A mother of a minor son B; transferred property in


favour of C on her behalf and on behalf of B. The
son B after getting majority challenged the said transfer
and court held that the transfer upto the extent of

share of B is void. Thereafter before the B could


take the possession he dies in a road accident and
A being legal heir of B inherited the same property.
Now C sues A for transfer of same property to
him under section 43. Decide whether C would
succeed? (20)

4. Explain the Rule against Pe{petuity. What is the


procedure prescribed under Transfer of Property Act
1882 to transfer property for the benefit of unborn

5. (a) Explain the Doctrine of Lis Pendens.

(b) A files a suit against B for possession of property.


But the plaint is returned by the court after
preliminary finding that the court does not
have pecuniary jurisdiction. Before A could file
the same before the proper court B gifted the
property to C. Whether the gift deed is hit by lis
pendens ? (20)

6. (a) Define Mortgage and discuss various kinds of


mortgages contemplated under section 58 of the
Transfer of property Act, 1882. ·

(b) A creates Anomalous Mortgage of property in


favour of B for a period of 99 years with the
condition that the entire amount along with interest
would be payable at the time of redemption and
property can be redeemed within 6 months after
the completion of the term. Whether these
conditions of the mortgage amounts to Clog on
equity of Redemption? Decide. (20)

7. A group of Delhi Government employees acquire land


for Co-operative Group Housing Society. The rules
of the Society provides that no flat of the society can
be sold to any non Delhi Government Employee.
Decide whether such condition is valid as per legal
