KASAMBAHAY CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This Service Contract made this 10th day of May, by and


between, DEARLIT JANE C. GOLO of legal age, single, with postal
address at 20, San Antonio Village, Matina Crossing, Davao City,
Davao del Sur, hereinafter referred to as the EMPLOYER

- and –

MARIVIC O. OTACAN of legal age, single, and a resident of


Purok 4, Balucan, Talacogon, Agusan del Sur, hereinafter referred to
as the EMPLOYEE

WITNESSETH AND AGREED AS FOLLOWS:

A. DURATION

The EMPLOYER and the EMPLOYEE hereby agree to a one (1)


year of employment commitment unless the EMPLOYEE is terminated
for cause.

Both parties agree to a give at least one (1) month notice before
job termination unless the EMPLOYEE is terminated for cause.

B. DUTIES AND RESPONSIBILITIES OF THE EMPLOYEE

The EMPLOYEE shall perform the normal duties as a


personal/domestic staff and agrees to perform the following checked
duties as requirement of her employment:

 Put the absolute safety of the children first before all other
responsibilities;
 Tend to children’s basic needs such as bathing, dressing,
changing diapers, brushing teeth, and afternoon naps;
 Administer medicine to children as directed by employer;

 Prepare meals for children during scheduled hours;


 Clean up kitchen and dining table when completed;
 Participate and supervise activities with children;
 Take notice of children’s meals, naptime, medication,
activities and educational progress;
 Keep the children’s bedrooms and play area clean and
organized; which includes making the beds, cleaning and
disinfecting toys, etc;
 Clean children’s laundry (clothes and bed linens).

The enumeration above is not an exclusive list and from time to


time the EMPLOYEE may be asked by the EMPLOYER to perform
additional duties that contribute to the safety and well-being of the
children.

B. WORK HOURS AND ACCOMODATION

The EMPLOYEE shall be staying-in the residence of the


EMPLOYER and will perform her duties from Monday through Saturday.
The EMPLOYEE will be provided with accommodation and food free of
charge. Sunday shall be her off-duty for the week.

C. WAGES

The EMPLOYEE shall receive a salary of six thousand pesos


(PHP6,000.00) per month, and shall be paid every 15 th and 30th of
each month in the equivalent amount of three thousand pesos
(Phph3,000.00).

D. MEDICAL

It shall be the duty of the EMPLOYER to provide medical


treatment and attention in hospital for the duration of illness or
accident with full wages for the first month of illness. Thereafter, the
wages will cease but medical treatment and attention will continue, if
however, in the opinion of a qualified medical officer the EMPLOYEE
will not be fit for further service with the EMPLOYER within a
reasonable time, arrangements will be made to ensure that the
EMPLOYEE will be able to return home.

E. VACATION/SICK PAY/HOLIDAYS

The EMPLOYEE shall receive payment for regular and special


holidays. The EMPLOYEE shall receive a total of two weeks paid
vacation (10 weekdays) and shall receive a total of one week (5
weekdays) sick days per year.

F. CONFIDENTIALITY

The EMPLOYEE understands that any and all private information


obtained about the EMPLOYER during the course of her employment,
including but not limited to medical, financial, legal, career and
EMPLOYER’s assets are strictly confidential and may not be disclosed
to any third party for any reason.

G. GENERAL

The EMPLOYEE understands the Employer has a smoke free


home and that smoking by the EMPLOYEE or the EMPLOYEE’s guests
is never permitted in the home. The EMPLOYEE agrees never to
smoke while providing childcare to the EMPLOYER’s children even on
walks, trips to playground, outside activities or field trips.

All guests must be pre-approved by the EMPLOYER before


being allowed entrance into the EMPLOYER’s home.

The EMPLOYEE hereby certifies that she does not use illegal
drugs and understands that such use is cause for immediate
termination.

The EMPLOYEE shall not accept any other employment while


working for the EMPLOYER.

H. DUTIES AND RESPONSIBILITIES OF THE EMPLOYER

That the EMPLOYER shall pay the agreed upon monthly salary
and shall shoulder the remittances with the SSS, Pag-Ibig, and
PhilHealth.

That the EMPLOYER shall provide the EMPLOYEE with medical


assistance in the form of first aid medicines, in case of illness and
injuries sustained during the service without loss of benefits.

I. TERMINATION

The following shall be the grounds for immediate termination


with cause:
a) Allowing the children’s safety to be compromised;
b) Inconsistent or non-performance of agreed upon job
responsibilities;
c) Dishonesty or lying to the Employer;
d) Stealing;
e) Breach of confidentiality clause;
f) Unapproved guests;
g) Smoking while on duty; and
h) Illegal drug use

The terms and conditions of this CONTRACT shall not be


modified or amended by either party without the concurrence of the
other party.
