Obligation is a juridical necessity to give, to do or not.

Contract is meeting of minds between two or

persons whereby one binds himself with respect to another to give something or render some services.
Obligations and contract play a vital role in business establishments. First, the contract serves as record
of commitment for both parties. Contract are relationship to both parties that they agree that they will
work together. Second, they prevent conflicts and dimmish risk, they both process negotiation that
ensures each one of them has an obligation that the outcome must be successful. Lastly, obligations and
contracts serve as collaboration and communication tools, teams can work together to determine their
needs through the creation of a contract and building healthy communication. By this, both sides can
feel confident in the final outcome because of solid communications. One hope in establishing a
relationship through contract is that the contract goes into a drawer, everyone knows what they’re
supposed to do, they do it and no one ever has to look at the contract again. But, in the event that
things don’t go that way, there’s a relationship on paper that spells it all out so a resolution can be
reached.

As a hotel manager in the near future. I know building a business is exhausting and complicated because
you might deal with some different issues. Obligations and contracts refer to what is legally required of
each of the parties involved in contractual agreement. One of the significant benefits of having a written
contract is that makes the parties to the contract actually have to talk about their obligations and
liabilities are going to be under the contract and put this down on paper. I will give two examples
situation that I could use the obligation and contract. First, if someone invest in your business and an
issue arise and the clients decides to work with different agency halfway through the project, you can
take a legal action because both parties signed a contract. Lastly, for instance if the payment isn’t
remitted by a certain date, the contract outline what the late payment fee will apply. So, obligations and
contract are very important when you are conducting business because if a problem arose, the two
parties could take issue to the court and a judge would hear the case. In that case putting your contract
in documented in written form would be significant.

The most common case here in the Philippines especially in any food establishments or restaurants is
the case of Bindseil v. McDonald’s Restaurants of Canada Limited. Foodborne illness is the most
common case here in the Philippines, every year Philippines has a new case that is related foodborne
illness. Just like what happened during the 90th birthday celebration of Imelda R. Marcos, the former
first lady of the Philippines. More than 300 people have been hospitalized due to suspected food
poisoning, hundreds of the estimated 2,000 people at the event apparently became ill after eating
chicken adobo, rice and eggs. Food poisoning is an illness caused by eating contaminated food, its
usually came from poor sanitation and poor hygiene and the best why to avoid this cases by cleaning the
kitchen and stored the foods or ingredient to its right places. But in the case of bindseil, Mr. Bindseil
suffers ulcerative colitis which is an inflammatory bowel disease (IBD) that causes inflammation and
ulcers (sores) in your digestive tract. Ulcerative colitis affects the innermost lining of your large intestine
(colon) and rectum. It just happened, The timing of his illness and the symptoms suffered by the other
patron witnesses raises suspicions about the food.
