1. The separate but equal doctrine stated that the separated facilities for colored and white people
was acceptable. They justified this by declaring constitutionally said it was being misinterpreted
by colored people
2. In Brown v. Board the court used arguments based upon the state of the schools for the colored
children. This included the travel of the students farther than needed and how all schools give
less qualified education.
3. In 1954, the equal protection clause was that no state could deny the equal protection of laws
to any person. It was then based on one's color. Now, it has spread to one's religion, national
origin or legal status or strict scrutiny. It based on someone's gender, wealth, disability and age.
