Franklin Mistrial
Franklin Mistrial
THE ABOVE STYLED AND NUMBERED CAUSE CAME ON for trial on May 5fil and
6'h, 2021. The Defendant appeared before the Court in his own proper person and represented by his
counsel of record, Marcus A. Williams and John Curtis Hall, II. The State of Mississippi appeared
by and through Assistant District Attorneys Katie Moulds and Ashley Allen. Both parties having
announced ready for trial, voir dire and trial proceeded. A jury composed of good and lawful
citizens of Madison County, Mississippi, being duly qualified as jurors in this cause, were selected
by the parties to serve in this cause. During the course of said trial, defense counsel, John Curtis
Hall, II repeatedly argued with the Court's zulings on a number of the state's objections, directly
addressed the jury in response to objections and was frequently disrespectful to the Court to such a
degree as to cause irreparable prejudice to the proceedings. The Court is given considerable
discretion in determining whether a mistrial is warranted since it is in the best position to measure
prejudicial effect. Upon hearing the state's motion and the defendant's response, this Court having
considered all circumstances held that there was a manifest necessity for a mistrial.
IT IS, THEREFORE, ORDERED that a mistrial is declared and that this cause be reset on
the trial docket of the Court. All jury costs to be assessed to Attorney John Curtis Hall, II.
