d. CODE OF CONDUCT
- Architect shall employ his services for the owner’s Residential Project with skill, care and
integrity.
- The Architect shall not engage in favors, interests or opportunities that might adversely affect the
project’s vitality.
- Except for the owner’s consent, the architect shan’t misuse project material for independent
functions.
- Architect shall comply to proposed terms and conditions, ensuring service fulfillment by the
project’s closure.
- Misunderstandings, disputes shall be resolved through joint negotiations, considering opinions on
both parts.

- Context studies: Includes neighboring mapping, licensing services, generating road-sewer connections.
- Design elements: Entail furniture choices or bespoke considerations for fixtures or appliances.
- Financial advisory: Budgeting/ advising on quantities, inspecting work procedures and monitoring
schedules and rates.
- Negotiations: Dealing legal disputes, mortgages, planning authorities and tenders as an arbitrator
- Project Management: Regulating delivery mechanism from inception to execution
- Consultancy: Interior design, Graphics, Landscape, Quantity surveying, HVEC, Furniture, Lighting,
Electrical/ mechanical/ structural

CONDITIONS OF ENGAGEMENT
Architect- The architect shall act in matters of law and negotiations on the client’s behalf. He will not proceed
without the client’s consent, nor will any amendments be made in the client’s absence. Any materials, drawings,
data, finances will be held confidential unless the client allows for. Any discounts, favors that could lead to the
project’s failure will be prevented immediately. Financial charts or related expenditure will be made accountable
by the architect before the client’s knowledge.

Consultant- If a consultant is employed then, he becomes the person responsible for the particular task. In any
such case the architect will be omitted from being accountable. Anyhow, on the client’s content, the architect
may advise/ supervise the work alongside the consultant.

Contractor/ sub-contractor/ supplier- The contractor will be nominated by the client or the architect on his
levels of competence and effectiveness. Under any circumstances, the contractor/ sub-contractor will be
responsible for the project’s development. The client will have no objection towards the architect in such
conditions. The architect can therefore monitor the contractor’s work, supplier dealings and financial
regards on the client’s consent.
Site inspection- The architect will visit the site at project’s initiation and construction commencement. If,
however regular visits are required, the clerical staff will do so to check whether construction is in alignment
with proposed documents. All visits will be paid by the client.

Representative: A representative shall act on the client’s behalf making sure submittals are done as per the
architect’s proposal and site work is in coherence within the project’s framework. This shall make
procedures run smooth without unnecessarily delays if the client is not/ cannot be present.
Copyright- All documents and drawings, prepared during the project course will be in the architect’s ownership.
The client will however be provided documents in case the architect completes the final design proposal.
However, if the final design proposal isn’t executed, the client can therefore have permit to access the drawings.
The client will not be permitted to reproduce the design without the architect’s consent, or agreement of payment
in return for the architect’s consent.

Assignment- Neither the client nor the architect’s duties will be regarded if not for another’s written
consent.
Suspension and Termination- On account of force majeure, the architect give in immediate notice for being
unable to carry out proposed tasks. The client can suspend the agreement by giving in a written notice to the
architect. If the architect hasn’t been notified within a period of 6 months to resume work, the architect will
notify the client in writing, if the notice isn’t responded within 30 days, the project will be considered terminated
by the architect. Termination of architect may be regarded by either party. In case of death or incapacity, the
client will pay dues either on contract or tender basis and have access to drawings and documents. The client
will therefore be allowed to proceed with the project but the drawings will be used for the proposed project only.

Settlement of disputes- Any arising disputes will be brought forward before an arbitrator who’s nominated
either by the client or the architect. The negotiation is based on a joint statement of resolved facts and the parties
accept the final verdict as a binding statement.

Governing laws- The application of these conditions will be governed under the Laws of Pakistan.
i. LIABILITY AND INSURANCE
Liability of the Architect- Any liabilities for the Architect will be applicable only if it violates the Owner
or proposed services aren’t properly executed.
Liability of the Owner- The owner will be applicable for liabilities only if his duty to the architect isn’t
fulfilled as per the documents.
Compensation- The value of compensation will be regarded of how much damage or loss is done by either
party by breaching the document. If a third party is involved, the compensation rate will be evaluated by how
much liability is proportionate to his violation of the project.

Duration of liability- Neither the client nor the architect will be held liable if the loss/ damage is pointed
out within 6 months after the project has been closed.
Payments to the Architect
Initial payment will be paid in advance with 5000/sqft and be deposited in the architect’s account with an invoice,
credited by the owner. Payments shall be made upon deliverance of each service. In case of non-payment, the
cost shall be charged in respect to the standard interest rate. The owner shan’t impose penalties or liabilities and
withhold sums to provide for the architect’s compensation with the architect’s consent or if architect is liable in
a dispute to the agreement.
