Contracts
Contracts
Confidentiality
Exclusivity
This contract outlines the description of a buyer who agrees to purchase goods from a
certain seller, so that the seller is the only provider of the goods. This contract makes
business for both parties fairer.
Employment Legislation
It is extremely important to maintain a safe work environment for all members involved in a
film set. If an injury were to occur it could cause the studio to get into a lot of trouble and
the injured person to be compensated in large sums of money. It is a good idea to run a risk
assessment before shooting and getting crew on the set. A risk assessment is looking for any
potential hazards and figuring out how to prevent any injuries from happening.
Shown below is my risk assessment that was done while shooting a BBC music video.
Equal Opportunities
Equal opportunities are the right to be treated without discrimination especially in the
aspects of age, gender, race and sexuality. The media industries are good at treating all
equally as there are a number of people with disabilities who work on films sets or act. This
is the same with gender, both men and woman are able to work in the media industry
without an issue.
Employment Equality (Age)
This is the act of not discriminating against someone due to their age, unless justified. An
example of this would be that if a film was looking for an actor to play an 18-year-old
character, a 50-year-old could not do this. This would be justified. If a film crew would not
hire someone due to being "too old" for something like being a camera operator, this would
not be justified as they are able to do the job just as well, if not better with experience.
Employers Liability
"Employers' liability insurance covers you and your business for compensation costs if an
employee becomes ill or injured as a result of the work they do for you. It's legally required
of all businesses with one or more employees." The 1969 Employers Act meant that all
employers would have to have some kind of insurance in the circumstances of something
such as this happening.
Employee Rights
Intellectual property
Copyright / Trademark
Copyright / Trademarks are a way to gain ownership over something that you have made or
that is yours. This can be sound, video, logos, names, etc. Once one of these things are
copyrighted or trademarked, it means that it belongs to you and nobody else can claim that
it is theirs or copy it, and if they do, they will get into legal trouble.
Ethics
Codes of Practice
"A code of practice can be a document that complements occupational health and safety
laws and regulations to provide detailed practical guidance on how to comply with legal
obligations and should be followed unless another solution with the same or better health
and safety standard is in place or may be a document for the same purpose published by a
self-regulating body to be followed by member organizations."
"Policies and procedures are designed to influence and determine all major decisions and
actions, and all activities take place within the boundaries set by them. Procedures are the
specific methods employed to express policies in action in day-to-day operations of the
organization."
Representation
Representation is how age, gender, ethnicity, race, etc. are addressed and presented to an
audience by text. Media text is extremely powerful and has the ability to morph something
into something that it’s not and convince people something that is not true to be true.
Legal
"The Obscene Publications Act of 1959 created a new offence for publishing obscene
material, repealing the common law offence of obscene libel which was previously used,
and also allows Justices of the Peace to issue warrants allowing the police to seize such
materials.", this was one of the biggest changes to date in the film industry.
The Race Relations Act 1976 was established by the Parliament of the United Kingdom to
prevent discrimination on the grounds of race. Items that are covered include discrimination
on the grounds of race, color, nationality, ethnic and national origin in the fields of
employment, the provision of goods and services, education and public functions.
Broadcasting Act 1990
"The Broadcasting Act 1990 established a new framework for the regulation of independent
television and radio services, and the satellite and cable television under the act, the
Independent Broadcasting Authority (IBA) and the Cable Authority were dissolved and
replaced by the Independent Television Commission."
BBFC
Ofcom
OFCOM is mainly a regulation body in the UK of which has a very wide range of duties that
they must follow to ensure the viewer has the best content. It ensures that people in the UK
get the absolute highest standard of communication services and are completely protected
from being scammed out of their money. They do this while also ensuring that the
competition in the industry is still there.
